OUTRAGEOUS! AUDIT IS OUTSOURCED!

FIXED TERM EMPLOYMENT ENTERS IA&AD

The much dreaded fixed term employment is being introduced into IA&AD. This is what a circular issued by CAG under the title “Young Professionals Programme” means. Copy of the ‘circular’ is attached. This move is, in other words, nothing but combination of outsourcing and contractorisation of hitherto ‘sacrosanct” functions of IA&AD – i.e. audit. It is three in one – fixed term employment, outsourcing and contractorisation.

As per the above programme, young professionals would be recruited for two years (on contract basis) to conduct the audit that are till date done by the personnel working in IA&AD.

This move of the CAG is nothing but negation of the spirit of the constitution and is a direct onslaught on democratic India.

It is in the interest of the personnel of IA&AD and the people of this country that we oppose, fight and defeat this move to contractorise the functions hitherto discharged by personnel of IA&AD as well the concept of fixed term employment.

All Units should take special efforts to take the danger involved in the move of the CAG in outsourcing the functions of IA&AD by raising the slogan “No Outsourcing/contractorisation of functions of IA&AD”. Wide circulation may be given to the CAG’s notification and our comments against it.

HOLD DHARNA ON 5^TH DECEMBER 2018

The CWC held at New Delhi on 4-5 September 2018 decided for phased agitations on the charter of demands, especially focusing on 5 –time promotion, cadre restructuring, restoration of statutory pension (i.e. old pension) scheme amongst other demands.

We observed Demands Day on 25^th October by holding lunch hour meetings and submitting the charter of demands adopted in the meeting.

It was also decided to hold a day long dharna by the Executive Committee members on 28^th November 2018 as second phase of the agitation.

The proposed dharna on 28^th November 2018 is rescheduled to 5^th December 2018.

All the Units may make campaign on cadre restructuring, 5 time promotion, NPS, promotion and integration of DEO cadre with the mainstream cadres and other issues in the charter of demands. The danger of fixed term employment cum outsourcing-contractorisation of audit should be given wide publicity and all personnel (irrespective of whether certain section is our members or not) be contacted and mobilised on the demands.

The Dharna shall be by the Members of the Executive Committee. Executive Committee members should apply for leave “for organisational work” (not special casual leave) and participate in the dharna.

The handbills and other propaganda materials used for the campaign on 5^th December 2018 Dharna may be sent to HQr by speed post/email (and not through whatsapp).

In addition, massive meeting should be organised during lunch hour.

COURTESY MEETING WITH ADAI

On 27^th September 2018, this Association had a courtesy meeting with Shri RS Mathrani, DAI (HR & LB). Immediately thereafter, charges of DAsI and ADAsI were reshuffled by CAG and HR& LB charge was allotted to Shri AWK Langsteih, ADAI.

We had a courtesy meeting with Shri AWK Langsteih, ADAI (HR & LB) on 19^th November 2018. The Association was represented by, in addition to the Secretary General, Comrades Tapas Bose, President, V Sreekumar & Anilkumar, Additional Secretaries General and G Rajagopal, Assistant Secretary General. Shri KB Jamal, Pr. Director, Staff and RK Choudhary, SAO/JCM were also present during the meeting.

The following issues were discussed:

1. Cadre Restructuring - we raised our concern over the delay and expressed our apprehension that the enthusiasm that was seen at the official end is not visible as of now.

We were informed that the draft report is getting finalised and is expected to be submitted by end of December 2018.

2. Denial of NFU to AAOs and Supervisors - all the facts were presented including functional responsibilities. The fact that Adhoc AAO is designated as Gazetted was also brought to the notice of ADAI.

ADAI assured to have a fresh look on the issue.

3. Functional Facilities to Associations at field level -

* Delay in recognition of Civil Audit Association, Allahabad – It was assured to effect check off system without any further delay.

** Denial of functional facility to Commercial Audit Cat 3 Association, MAB 1 & 2 Mumbai – It was assured to give time for the Association to enroll membership from MAB 2 (as the HQr office itself reversed its decision on Constitutional amendment)

*** Transfer of President of Defence Audit Association, Kolkata – It was informed that CAG’s standing order in this regard has been conveyed to DGA (Defence). As it has not been enforced, ADAI assured to intervene.

**** Non transmission of Resolution by AG/DG/PDA: We brought to the notice of ADAI that resolutions adopted by the field level Units are not forwarded by the field offices raising silly objections.

ADAI assured to look into the matter.

4. Shifting of AP office to Vijayawada: We presented the hardship and the loss that the personnel of undivided AP office would be faced with when posted to Vijayawada (on deputation). The fact that nearly 300 personnel – from MTS to AAO – would be forced to maintain two establishments was also presented. Loss on account of HRA, Transport Allowance and deprivation of CGHS facilities were also taken up. We requested for rescheduling of shifting of office to 2022.

ADAI stated that all concerned were notified about shifting of office from Hyderabad to Vijayawada in December 2017 itself. He further stated that the Accounts sections are already functioning from Vijayawada. He expressed the fear that if we don’t shift the office - i.e. the entitlement functions - in April 2019, the State Government may get a ruse to take over the functions in which case we will be the total loser.

(After meeting ADAI, President and Secretary General of Assistant Accounts Officers Association and Com G Rajagopal, General Secretary, Accounts Category III Association met Pr Director, Staff along with Secretary General and discussed the issues involved in detail. PD, Staff informed that HQr office took up the issue of grant of HRA and TA at Hyderabad rate to those deputationists who will be posted to Vijayawada with Deptt. Of Expr which did not agree with the proposal).

5. Recruitment in the Canteen and Regularisation of contract labour employed with Canteens

ADAI agreed to examine the issue.

While discussing this issue, we also raised the question of regularisation of personnel working on contract basis in different cadres in the Mizoram. ADAI did not comment on this.

OBSERVE DEMANDS DAY ON 25^TH OCTOBER 2018

The Central Working Committee meeting of the Association held at New Delhi on 4-5 September 2018 had called upon all the Units to observe Demands Day on 25^th October 2018 by holding lunch hour meetings and adopting the charter of demands.

One copy of the Charter of demands adopted by the meeting may be submitted to the HoD and another copy may forwarded (as advance copy) to the Comptroller Auditor General of India directly by speed post. This is to ensure that the resolutions do reach CAG office and the HODs do not sit over them.

A copy of the resolution containing the CoD (Charter of Demands) may also be sent to Secretary General by email (scanned copy) or speed post.

The CoD may please be popularized by multiplying and circulating it amongst the employees. CoD and draft resolution is given along with this Circular.

A report on the implementation of the programme may be intimated to HQr by the same day evening by email.

R E S O L U T I O N

This meeting of the …………………………………….Association, O/o ………………………………….held on 25^th October 2018 hereby adopts the following charter of demands.

Charter of Demands

1. Strengthen Audit & Accounts to Safeguard People’s Rights

Stop down-sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap Curtailment/shedding of Audit functions in the name of Audit Plan; ensure continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms; ensure effective Audit & maintenance of Accounts of Local Bodies by sanctioning adequate posts; revisit restructuring of Audit effected from 1..4. 2012 and rationalisation of staff strength in audit offices.

2. a) Amend Company Law and DPC Act for Audit of Public Sector Undertakings & Corporations even after reduction of Government share to below 50%.

b) Amend Company Law to ensure the Audit by IA&AD of all Public Limited Companies listed with Securities and Exchange Board of India (SEBI)

c) Enact necessary law to bring audit of all public Financial Institutions by IA&AD.

3. i) Implement Restructuring of Gr B & C cadres in IA&AD only after arriving at consensus with the staff side;

ii) Grant:

* Promotion to DEO as Auditor/Accountant

· Non Functional Upgradation to SA to Level 7 (GP 4600)

· Promotion of SA as AAO

· Combined seniority/gradation list of AAOs (including SAS personnel and promotees)

· Promotional avenue to promotee AAOs as AO/SAO and further depending on service

· 100% promotion on seniority basis against the total strength of AO and SAO Gr I, II, III on completion of 8 years from the date of promotion as AAO Gr I to the Pay Level 10

4. a) Vacate victimisation of Association activists.

b) Allow democratic functioning of Association without interference from administration

5. i) Fill up all vacant posts through local recruitment, coming out of SSC if required;

ii) Reserve 80% posts for those from the respective territory.

6. i) Withdraw annual audit criteria introduced vide letter dt 27 January 2011.

ii) Stop unilateral implementation of transfer policy in Commercial Audit & P&T Audit

7. Extend NFU to Level 9 to Adhoc AAOs; grant the NFU from 01.01.2006

8. Permit all Employees in the GP of 1800 to appear for all Departmental Exams including SOGE.

10. Designate Supervisor as AAO & Earmark 20% of AAO post for seniority cum fitness promotion in all wings

11. Stop downsizing of P&T Audit Offices; conduct audit of private service providers as per TRAI regulations, widen scope of audit.

12. Re-imburse hotel charges to Railway Audit personnel wherever Railway accommodation is not allotted while on tour.

13. Restore unilateral transfer policy.

14. Restore metal Pass facility to AAOs in Railway Audit

15. Restore/Extend JCM facility to AAOs (who were part of the scheme uptil 1984)

This meeting of ………………………………….Association resolves to urge upon the CAG of India to cause meaningful negotiation on the charter of demands and take all steps to strengthen the audit and accounts department.

This meeting also resolves to submit a copy of the resolution to the CAG of India through proper channel.

This meeting further resolves to send a copy of the resolution to Secretary General, All India Audit & Accounts Association, CSV Warrier Bhawan, 15/1089-90, Vasundhra – 201012, Dt. Ghaziabad, UP.

CWC MEET DECIDE TO INTENSIFY STRUGGLE

FOR:

* TRADE UNION RIGHTS

· 5 PROMOTIONS

· PROMOTION OF DEO AS AUDITOR/ACCOUNTANT

· PROMOTION OF SA AS AAO

· REGULARISATION OF CONTRACT/CASUAL WORKERS

AGAINST:

· NPS

· DENIAL OF FUNCTIONAL FACILITIES TO ASSOCIATIONS

The Central Working Committee meeting held on 4^th and 5^th September 2018 at New Delhi, presided over by Com. Tapas Bose, President, was attended by 33 units represented by 94 delegates & observers in addition to 3 special invitees. 24 delegates participated in the discussion on the note submitted by the Secretary General.

Senior Leaders Coms. Subhash Pandey, Nageswara Rao and KL Gautam addressed the house. Each one of them exhorted the delegates and observers on the need to strengthen the organisation at grass root level and thus the headquarters – organizationally and financially. The discussions were summed up by the Secretary General.

It was decided to build up a movement on Trade Union Rights, 5 promotions from entry level, Promotion of DEO as Auditor/Accountant, promotion of Sr Auditor/Accountant as AAO, Regularisation of casual/contract workers (including those employed with departmental canteen).

It was further decided to strengthen the struggle against NPS demanding restoration of the defined benefit scheme (i.e. old pension system) and attempts by the administration to curtail the functional facilities of the Association.

The CWC meeting decided to organise the following programmes in pursuance of the above demands:

1. Adoption of Charter of Demands by holding lunch hour meeting – 25^th October 2018

2. One Day Dharna by the Executive Committee at every station/Unit – 28^th November 2018

3. Mass Dharna in every Station/Unit

4. Dharna before CAG office

The date(s) for 3 & 4 would be decided later.

The CWC adopted following resolutions:

1. On Kerala flood relief

2. On cadre restructuring

3. On participation in the one day strike on 15 November 2018

4. On Delay in recognition of Associations and denial of functional facilities

5. Demanding suspension of Shifting of AP office to Amaravathi till April 2022

6. On continued attacks on the employees’ co-operative societies in various offices

7. Demanding recruitment of local people

8. On grant of permission to contest elections to employees cooperative societies

9. Demanding regularisation of casual and contract workers including contract workers in the departmental canteen

10. Demanding withdrawal of NPS and restoration of old pension scheme

11. Against downsizing of audit offices

12. On additional work to P&T Audit office, Nagpur

The CWC in a separate resolution urged upon the CAG administration to extend the check off system under CCS (RSA) Rules, 1993 to Federation.

Every delegate attending the CWC recorded their deep appreciation of Civil Audit Association, Delhi for the magnificent arrangements and warm hospitality. Com. Tapas Bose, on behalf of the National Executive Committee, thanked the leaders and activists of Civil Audit Association, Delhi for their humongous effort in hoisting the CWC meet.
