In the bilateral meeting on 20th April 2009 with Principal Director, Staff, the following issues were also discussed – rather certain clarifications and some amendments/improvements to the scheme of adhoc SO were sought - to in addition to the agenda items as given in the Circular 10.

 

Two of such issues were related to transfer of SOGE Civil Audit passed candidates from A&E office to Civil Audit offices. 

 

Some units have reported that there are some candidates in A&E offices who opted for SOGE Civil Audit only because there was no chance for any career advancement in A&E offices. Some of them have passed the papers of SOGE Accounts. Under the scheme given vide circular dated 25th March 2009 by CAG, these personnel would not be considered for adhoc promotion because they are candidates for SOGE Civil Audit.  It was also pointed out that some candidates, as in the office of AG (A&E), AP, Hyderabad, had represented way back in 2007 for being considered/declared as SOGE Accounts passed and their representation is still pending.   

We requested that relaxation to this clause may be given and a fresh option may be given to all such personnel to remain in A&E office itself, ie to withdraw from SOGE Civil Audit and considered as SOGE Accounts passed.

It was stated by Pr Director Staff that at this stage no such request could be considered. On being further requested it was stated that any request for relaxation can be considered after the implementation of the scheme.

 

We also took up the issue of taking SOGE Civil Audit passed candidates from A&E offices in Audit offices where vacancies in the SO/AAO cadre are limited or marginal.  

It was clarified that (P)AG (Audit) has to work out how many posts will be required to accommodate all such SOGE civil audit passed personnel and have to seek sanction for additional posts. It was further clarified that all such candidates from A&E offices would be taken on deputation against additional posts, without affecting the promotional prospects of future candidates in Civil Audit offices.

 

Another issue we raised was on the regularisation of daily wage employees. We were informed by Pr Director, Staff some scheme is being worked out and it is expected that we can expect some action in this regard soon.

Bilateral Meeting with Pr. Dir., Staff

 

Bilateral meeting was held with Pr. Director, Staff on 20th April 2009. Association was represented by Comrades M Duraipandian, President, MS Raja, SG, V Nageswara Rao, V Sreekumar, Additional Secretaries General and AS Rawat, Asstt Secy General. Com Subhash Pandey, Vice President couldn't attend due to ill-health. AC (N) and AO (JCM) were present in the meeting.

 

A brief on the discussion is given below.

 

At the outset Com M Duraipandian, President, expressed appreciation for the grand gesture by CAG on 27th March 2009 by getting up from his seat, shaking hands with President and Secretary General stating that 'there will be light at the end of the tunnel' at the conclusion of the meeting. He hoped that this gesture would percolate down to every level.

 

PD, Staff also put on record his appreciation for the factual recording done by the Association on the discussion with CAG.

 

The agenda items were taken up thereafter.

 

1. Vacate victimisation of Association activists; allow democratic functioning of Association without interference from administration.

 

On Kerala situation Pr Director, Staff stated that he is bound by the parameters set by CAG in his meeting with Association on 27th March 2009. Association presented certain instances where AG (A&E), Kerala is behaving in such a manner that does not befit a human being.

 

Regarding the suspension of Com PC Parikh, President of Civil Audit Association, Rajkot, Gujarat, PD, Staff stated that suspension for such a long period is not desirable and assured that he would intervene. 

 

The issue of insistence on constitutional amendment on quorum was raised by Association. After detailed discussion, PD staff agreed to have a re-look and put up to DAI. The situation in Kerala   where there are four branch offices in addition  to the Main office as well as the difficulty for mustering a minimum quorum in the case of SO(Comml.)/AAO (Comml) whose membership are scattered all over the country were placed in this context.

Similarly on the issue of amending the constitution of All India Audit & Accounts Association to make it a biennial conference, it was stated by Administration that it was sought for the purpose of ensuring submission of annual accounts. After discussion it was agreed that association will submit annual accounts on adoption by the CWC, subject to approval by triennial conference.

 

PD, Staff stated that circular on grant of special casual leave for organizational work would be re-iterated. It was also assured that non grant of special casual leave to members of SO/AAO (Comml) Association – especially in Kerala – would be attended to.

 

2. Strengthen Audit & Accounts to Safeguard People's Rights

 

a)      Stop down sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap curtailment/shedding of Audit functions in the name of Audit Plan.

b)      Ensure continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms.

c)      Ensure effective Panchayati Raj Audit & Accounts by sanctioning more posts.

 

Detailed discussion took place on the item. Association insisted that deepening and widening the scope of audit and accounts is what is expected of the department and is the need of the day when scams upon scams are breaking out every passing day.

PD, Staff stated that a review is being undertaken by the administration on the functional requirements. He assured that our view points are being taken into account in this respect.

 

We from our side requested that CAG take initiative in demanding more areas of work including audit of listed companies. It was stated by us that once CAG take the lead, we will go all out in mobilising the public opinion in its favour.

 

3. Redesignate LDC as Audit/Accounts Assistant, grant PB1 Grade Pay 2800 (4500-7000 pre-revised) and grant following pay scales to other cadres, maintaining vertical relativity.

                                    SA/Steno Gr I                                        : PB2, GP 4600

                                    SO/AAO/Private Secretary       : PB2, GP 4800

           & PB3 GP 5400 on completion of 4 years

It was stated by administration that they would check how error was crept into the advertisement for the post of DEO giving the pay as pre-revised pay scale of 4500-7000.

 

The Association stated that creation of cadre of DEO would have future ramification as that cadre would be out of the hierarchy of cadres obtained in IA&AD. We pleaded for re-designation of the cadre as Audit/Accounts Assistant placing all the existing LDCs in that cadre as one time measure.

It was stated by PD, Staff that the demands under this item would be considered at the time of cadre review/restructuring that is underway that is expected to be concluded in another 3-4 months. He assured that the Association would be consulted before any final decision is taken.

 

It was assured that grant of grade pay 4200 to Auditor/Accountant would be taken up once again with the MOF.

 

4. Fill up all vacant posts and sanction adequate post as per the agreement of 16.10.1992

 

The Association was informed by PD, Staff that the 500 dossiers for the post of Auditor/Accountant has already been received from SSC, in addition to that of DEOs. It was stated that presently, Accountants are recruited only in offices of AsG (A&E) at Uttarakhand, Chhatisgarh and Arunachal Pradesh. In the case of Auditors, initially, in such offices where the vacancy position is above 35% of the sanctioned strength, the recruitment would be done.  We were informed that bulk recruitment in any cadre will create a situation of stagnation in the days to come and hence recruitment would be done in phases. It was assured that there would be continued recruitment in the Auditor cadre.

It was further informed that final picture would emerge only after the finalisation of cadre review that is underway.

 

5. Grant ACP on hierarchical pattern.

 

PD, Staff informed that if we insist on grant of ACP on departmental hierarchy, we may have to forego the recommendation of 6 CPC for 3 ACP (which is not based on departmental hierarchy but the hierarchy of grade pay).

 

To avoid loss to the LDCs, PD, Staff stated that the diversion of direct recruitment quota for promotion quota can continue for one or two years more and examinations could be conducted wherever necessary so that no LDC remains for availing ACP.

 

6. Re-designate Supervisor as Section Officer; grant further promotion upto AO/SAO; earmark   20% of AAO (SO) cadre for Supervisors.

 

Regarding re-designation of Supervisor, PD Staff informed that it is a bigger issue that could be discussed later. As regards earmarking 20% of total strength of SO/AAO for promotion of Sr Auditor/Accountant as Supervisor, Pr Dir Staff responded positively stating that taking the total strength of SO/AAO cadre to grant promotion to SAs as Supervisor could be considered, but it may not be 20%. He said that this could be discussed along with the cadre review.

 

7. Restore Unilateral Transfer policy

 

It was stated by Pr Director Staff that in the given situation restoration of unilateral transfers is not possible.

 

8. Revise TA/DA rates and permit self certification to claim re-imbursement of food and conveyance charges.

 

PD, Staff agreed with the view that present situation is creating certain difficulties for the field staff. But the MOF with whom the issue was raised refused to relax the conditions and rejected the request for permitting self certification, instead gave an option of retaining the pre-revised set up, informed PD, S. The Department would write to government requesting to revise the old rates commensurate with the prevailing price line, assured Pr Dir, Staff.

 

9. Placement of all matriculate Gr Ds in PB I, Grade Pay 1900

 

The scheme does not differentiate between matriculate and non matriculate on placement to PB1, but only on upgrading the skill of the unskilled. Hence it is not possible to grant GP of 1900 to matriculate Gr D, informed PD, Staff.

 

We were told that the meeting with DAI would be arranged in the month of May 2009.

 

SLOWLY, SOME IMPROVEMENTS

 

The developments in the recent past definitely point out to welcome changes in the attitude of CAG administration. It might not be fully upto our expectation, but one has to accept and be receptive to positive signals and actions. After a long gap of nearly a decade, there is going to be some fresh recruitment in the cadre of Auditor (/Accountant). Some DEOs are also going to be recruited soon. Against a vacancy position of 16000 it might seem to be too little, still it is a big step reversing the trend.

 

The sustained agitation that we launched for the last few years has begun to make its impact. We cannot be complacent; this reminds us of the onerous task ahead – to carry the struggle ahead.

 

It also reminds us of our greater responsibility. To ensure probity in government functioning, mass awakening is required, simultaneously raising our own standards – of the department's as well as we the personnel working in IA&AD.

 

We have to carry forward the struggle to ensure that the department does not dodge its responsibilities and the executive does not dare to browbeat the department by mass campaign by rallying the intelligentsia and the common man, preparing our own employees for a sustained agitation so as to prevent the friends of liberalisation and outsourcing from having their way.

 

Though we can draw some relief from the fact that the struggles have started showing results, as stated earlier, we shall have to carry the struggle to new heights.

 

Every Unit leadership may take pains to carry the message to the mass of employees.

OBSERVE ALL INDIA ASSOCIATION DAY ON 15TH APRIL 2009

 

One more 15April - once again the memories of great sacrifices and great struggles evoke feelings and emotions that are unparalleled; something that is unique only to the audit employees' movement.

 

86 years back our predecessors sat together in Nagpur to formally record resentment over the downgrading of the UDC of IA&AD to the level of UDC of subordinate offices and to plead restoration of the parity in status and pay scales.   

 

Over the years the movement traversed through ups and downs, becoming the leader of CG movement through out the country, fighting against odds and overcoming the "insurmountable".  

 

Our movement has produced leaders of exemplary qualities – at all levels - who faced the onslaughts by the die-hard bureaucracy in IA&AD and served the movement with total dedication.

 

It is these qualities of sacrifice and dedication of our predecessors and the present day leadership that keeps the Audit Flag fluttering even today, facing worst kind of victimisation as in Kerala, Rajkot, Gwalior and Kolkata.

 

On this Association Day let us pledge to carry forward the great legacy of sacrifice and total dedication towards the movement to carry the struggle and the movement ahead. Rededicating ourselves to the further advancement of the movement would remain meaningful only when we – from the members of  the National Executive Committee to the ordinary member – join hands with the employees and workers outside in the fight against the policies that are being pursued for the nearly two decades as part of the Liberalisation, Privatisation and Globalisation.

 

Let us pledge to enroll every employee and officer as a member, raise the level of every member to that of an activist and bring up all the activists as leaders and to raise the vision and understanding of leaders to an enviable level.

 

CONFEDERATION CALLS FOR EXERCISING

THE RIGTHT OF FRANCHISE JUDICIOUSLY

 

The National Executive of the Confederation of Central Government Employees and Workers met at New Delhi on 2nd April 2009. The meeting recounted the experiences of the Central Government employees since 2004. It took note that the government went to the extent of using National Security Act against leaders and members during the recent strike by the employees and workers working in under the Ministry of Health.  The great disparity in wages that has been brought about by the 6 CPC was not even discussed and resolved; the recommendation of 6 CPC on abolition of Gr D posts has not been rejected, rather it has been accepted and acted upon; the ACP scheme is still not implemented and no discussion is held with staff side. Contractorisation of regular jobs has become order of the day. There are nearly 20 lakhs vacancies in the Central and State Governments together and these are not filled in; on the contrary ban on recruitment is further extended.

 

The National Executive of Confederation adopted a resolution unanimously. Confederation Circular and resolution adopted in the meeting of National Executive are enclosed

.

All Units are requested to translate it into regional languages and give widest publicity to the resolution and also hold gate meetings.

 

ON CERATIN DEPARTMENTAL ISSUES

 

It has been clarified by the CAG administration that the transfer of SOG (Audit) personnel from A&E office to the Civil Audit Offices which are marginally deficit in SO/AAO cadre would be against additional posts of SOs that would be sanctioned so that promotional prospects of Auditors shall not be affected in the coming years.

 

Unit leadership of such units may take up the issue with local authorities.

 

Also, the CAG has issued order relaxing the economic criteria for appointment on compassionate grounds which in effect eases the situation to a great extent. The Circular very clearly states that economic criteria shall not itself disqualify an applicant if other conditions satisfy. Prior approval by HQr office has also been dispensed with. (The 5% condition imposed by the Govt stands).

 

Unit leadership may prevail upon the local administration to review the cases that has been rejected in the recent past.

            We send herewith the resolution adopted at the National Executive of the Confederation, which met today at New Delhi.  Kindly publish the same in your journal and circulate it amongst the employees.  We should organize meetings in front of all offices and convey to the members that the ACP orders are not likely to be issued before the election and the Government has not acceded to the demand of the Staff Side to continue the existing practice of effecting ACP on the basis of department specific hierarchical set up.  The grant of second installment of arrears of 6th CPC dues is also likely to be delayed and may not be released before August, 2009.  The meeting was apprised of the items finalized and forwarded to the National Anomaly Committee.  Those who require a copy of thereof, please send us requisition e mail at: confederation06@yahoo.co.in.

 

            The next meeting of the National Executive will be held in June, 2009. All affiliates are requested to clear the outstanding subscription dues and the special contribution of Rs. 20 per member by 30th May, 2009.  The National Conference (the triennial conference) is due in September, 2009.  Since the accounts are to be finalized and audited latest by 10th August, 2009, the due date indicated for remittance of dues may please be adhered to.

 Resolution adopted at the National Executive

Meeting of the Confederation.

 

            This meeting of the National Executive of the Confederation of Central Government employees and workers held at New Delhi on 2nd April, 2009 drew satisfaction from the response of the Central Government employees to the appeal made by it on 24th March, 2004 to mount vigorous campaign amongst the mass of the employees to take a decisive stand against the then Government at the general election in 2004.  With the sustained efforts and endeavour of the entire working class in the country a combination of those political parties who are opposed to fundamentalist and communal forces could be brought to power after the general elections in 2004 in the country.  Such a combination of the political parties thus took over the reins of the country with the support extended by the left parties from outside on the clear understanding that the cardinal principle of governance would be what was agreed upon by all concerned as the National Common Minimum programme.

 

The present Govt. at the beginning kindled the hope and aspiration of the common multitude of the country especially the working class. However once in power the Prime Minister and the Finance Minister unmindful of the strident opposition of the organized movement of the working class and disregarding the views of the Left Parties pursued the same discredited neo-liberal economic policies. The sponsoring committee of Trade Union organizations had to perforce tread the path of struggle and organize strike actions in 2006, 2007 and 2008 to compel the Government to reverse its economic policies of liberalization and globalization.  The ban on recruitment which was imposed by the NDA Govt. in 2001 through an executive fiat was not only not withdrawn but continued; many  Government departments were wound up; public enterprises were privatized; FDI was allowed in many sectors including the sensitive and strategic ones; initiated policy shifts making higher and professional education beyond the reach of the common man; service tax net was widened to cover many areas of concern to common man; various concessions and exemptions from taxation were provided to the rich and corporate bodies; subsidies were withdrawn driving peasants to penury; the only tax deduction available for the salaried employees i.e. the standard deduction under section 16 of the I.T. Act was withdrawn; capital gains tax on stock transactions was abolished to give impetus to speculative business at terrible cost to exchequer; allowed future trading on consumable food articles which became the primary cause for the escalation of prices of all essential commodities like rice, wheat, dhal, edible oil vegetable, sugar etc.; allowed the monopoly houses to enter the retail trade rendering thousands jobless; indulged in massive downsizing and outsourcing of the Governmental functions; raised the administrative price of petroleum products; proposed full capital convertibility of rupee; created innumerable special economic zones granting power to hire and fire to the entrepreneurs; persisted with the financial sector reforms unmindful of the global economic recession; introduced bill to withdraw the labour welfare enactments; did everything to integrate Indian economy to the vagaries and dangers of globalization; weakened and almost wound up the public distribution system; all this done in contravention of the agreed National Common Minimum programme.  

 

At the instance of the proponents of the free market economy and with a view to boost the stock market operations the Government decided to privatize the pension funds and do away with the age old statutory defined benefit pension scheme of the Government employees by introduction of the PFRDA bill in the Parliament.  Almost all the State Governments barring Bengal, Tripura and Kerala followed this dictum and introduced the new contributory pension scheme. Despite the stiff opposition of the Central and State Government employees manifested unambiguously by a magnificent strike action on 30th October, 2007 jointly organized by the Confederation and the All India State Government employees Federation, the Government persisted with the PFRDA bill which however could not obtain the Parliamentary sanction due to the principled and consistent opposition of the Left parties.  Still the Government put into operation the new contributory pension scheme in fact illegally and unethically through executive instructions. At the fag end of its tenure it decided to divert the pension funds to stock market to boost up the falling sensex. 

No different was its attitude towards the employees in the matter of implementation of the 6th CPC report.  The report itself was to perpetuate the wage differential between the top echelons of the bureaucracy and the employees. The Government's decision was to accentuate this ill advised recommendation further as it chose to accept the suggestion of the Committee of Secretaries to further increase the Grade pay of all Group A officers and reject the demand of the employees for a fitment formula to provide a minimum benefit of 40% rise in emoluments to all employees.  It refused to grant the minimum wage as per the 15th ILC norms and refused to negotiate the recommendations of the 6th CPC with the employees' representatives.  It also decided to do away with 9 lakhs Group D posts and outsource all Group D functions to private contractors.  On the question of wage revision of 3.5 lakhs Grameen Dak Sewaks, the Government took initially an extremely nugatory attitude by not setting up a judicial committee for their wage revision and later by not revising their wages.  Same was the attitude of this Government towards the temporary and casual workers. While the regular employees were given the benefit of wage revision, the casual and daily rated workers were denied. Even after issuing orders for the grant of Child care leave for women employees as per the recommendation of the 6th CPC, the Govt. later issued a clarificatory order virtually denying this benefit.  In the case of pre-1996 pensioners the benefit of fixation on notional pay basis was denied. Even in the face of the impact of the world economic recession, it refused to lift the ban on recruitment, fill up the large number of existing vacancies or take steps to generate employment as demanded unanimously by the entire trade union movement in the country in the recently concluded Indian Labour Conference

During the five year tenure, it discarded India's independent foreign policy and moved away from the time tested non-aligned movement. It compromised the country's independent nuclear technology development programme by entering into a controversial agreement which became the subject matter of severe criticism from various quarters.   While this had been the track record of the present Government, the major constituent of the opposition had been indulging throughout this period to foment social disharmony, to spread hatred and to fracture the secular social fabric providing impetus to the growth of terrorism.    

In this background the National Executive appeals all affiliates and COCs to campaign amongst the mass of the employees and the people of the country to vote for those candidates who support the cause of the working class in general and Government employees in particular. The meeting calls upon all concerned to organize state/district level conventions and mass meeting in front of all offices to organize the employees for this purpose.
