Dear Comrades,

The agenda meeting with AWK Langstieh, DAI (HR) was held on 16th September 2019. DG, Staff, AC (N), SAO/JCM & AAO (JCM) were present from the administration Staff. The Association was represented by Comrades Tapas Bose, President, KC Mathai, Vice President and Anilkumar, Additional Secretary General in addition to the Secretary General.

Brief on the discussion on agenda items is given below.

1.                              Restructuring of cadres in IA&AD
DAI informed that the report submitted by V. Kurian Committee is now under the consideration of top management. He assured to expedite the decision making process but did not commit on a deadline.
DAI further stated that on finalization of the same by the Department it will require approval by the nodal ministry and DOPT and thereafter by the Union Cabinet which will take its own time.

2.                            5 time promotion to all cadres from entry level
      DAI assured that cadre restructuring committee is seized of the matter. Lack of   promotional avenues and resolution there-of is being considered.

3.                            Promotion of DEO as Auditor/Accountant
The promotional avenues for all cadres including DEOs will be taken care of by the cadre restructuring, assured DAI.
4.                  Conduct SAS exam in the old format, grant unlimited number of chances to Part II candidates and undo system of negative marks.

DAI did not agree to revert back to old format, but assured to revisit the question of number of chances.
5.                           Conduct SAS exam in A&E offices
It was stated that SAS (Audit) has been opened for all in A&E offices where the vacancy position is 10% or less.
Further review would be undertaken on finalization of cadre restructuring.

6.                            Recruitment of local personnel in all non gazetted cadres & opening up of Unilateral transfer
It was informed that DOPT has been moved to amend RR of certain cadres adding the condition of knowledge of local/regional language as requirement, as a test case. On approval of the same by DOPT, the Department will approach SSC to recruit personnel accordingly.
      Opening up of unilateral transfer cannot be considered now, said DAI.

We were also informed that deputation channel is available for those who are genuinely in need of it. In this context, when it was pointed out that many offices are not circulating the deputation related notifications amongst the staff members, DAI agreed to upload all such notifications in the CAG website which will be accessible for all.  

7.       Re-designation of Supervisor as AAO and grant of NFU at Level 9 to Supervisors on completion of 4 years.
It was assured that the demand would be further examined.

8.                            Grant of full functional facilities to Associations
DAI agreed to re-issue the circulars regarding facilities to Association with      directions to follow them.
He also assured to resolve the pending recognition related issues. (we made specific reference to MAB, Mumbai, Southern Railway Audit, Chennai, Bihar Civil Accounts Association, Western Railway Audit, C knowledge of local/regional language as requirement Cat 2 and Allahabad audit).
To a specific reference to the discontinuance of membership of Sowmitra Bandopadhyay of Defence Audit Association on his outstation transfer against the extant orders, DAI assured take corrective measures.

9.                            Inclusion of AAOs under JCM Scheme
DAI informed that DOPT did not agree to the proposal.
10.                        Fixation of Pay on promotion as Supervisor after grant of MACP at GP 4600
We were informed that DOPT has refused to reconsider the present position stating that it is as per 7 CPC recommendations.

11.                        Uniform nomenclature for all cadres upto SAO.
DAI said that this can be considered when cadre restructuring is finalised and ready for implementation.

12.                        Filling up of vacancies/recruitment of personnel in the Departmental Canteens
DAI agreed to expedite the process of recruitment in departmental canteens.
We insisted on regularizing all contract staff working in the canteens. DAI agreed to examine the demand.
13.              Implement SC judgement in WP (Civil) No. 82 of 2011 to “civil servants” only; no transfer of Gr B & C personnel under the cover of the said judgement.
DAI enquired whether this demand to specific to outstation transfer or to all transfers even with in the station. We said that it is specific to outstation transfers and made a reference to transfers in MAB, Hyderabad to Vishakhapatnam.
DAI agreed to examine.
14.                       Restore sports quota recruitment.
The recruitment notification is already issued.
On recruitment in the Volleyball stream DAI informed that the HQr is collecting data from all offices and it would be processed and decision would be taken soon.

15.                        Liberal approach on Compassionate Ground appointments
To our insistence of excluding the value of house from the financial status, DAI assured to review and if found necessary to revise the conditionalities on financial status of the dependents of the employee who died in harness.
        He further stated that it is upto the Accountant General to take a judicious decision based on the committee’s recommendations and HQr cannot intervene on this.
16.                       Prospective application of “very Good’ Bench mark for MACPS
DAI pointed out that it under discussion in NC, JCM and Department would implement the decision of DOPT on this.

17.                        Grant of additional work to P&T Audit, Nagpur
DAI proposed to refer the item to DGA, P&T and asked us to meet DGA, P&T to sort out the matter.
18.                       Grant of NFU to Level 9 to Adhoc AAOs
DAI assured to examine it once again after calling for details from field offices on the number of persons affected
Presentation on One IA&AD, One System (OIOS)

            Prior to commencement of the agenda meeting, there was a presentation on One IA&AD, One System by the IS Wing, HQr. Shri Sriram, DG made the presentation in the presence of DAI.

            In nutshell, it proposes to make the audit to wholly IT based. Every Auditor/Senior Auditor, AAO, AO/SAO would be given laptops, key documents would be captured in camera, every communication with the auditee organisation and also within the audit party and also the office/wing would be online with back-ups. The idea is to paper-free audit offices. It is proposed to start it as pilot project in certain offices/wings.

            Though we do accept that we will have to adopt most updated IT system in the present world in our discharge of duties, certain doubts remain on the practical side of it. And we raised those doubts.

1.      If there is a theft or loss of lap top, the personnel will be penalized, he/she also will be preceded under CCS (CCA) Rules – is there is any guarantee/protection against that?
2.      What about the connectivity – even in cities connectivity is poor, how it would be in mofussil areas and villages? How the work as well as data transfer can materialise? (It was pointed out that in the city of Delhi itself downloading of GST related documents takes lot of time).
3.      What would be role of DEOs?
4.      What would be the reduction in PIP in the HQr sections?
5.      Whether the field offices would be robbed off the functional autonomy as every action would require approval of HQr.
6.      Whether it will help in improving transparency at all levels?

            These doubts were raised. IS wing also shared some of the concerns such as connectivity, loss/theft of lap top etc. But other points were mostly left unanswered.

            (In addition, many more issues that may affect the personnel may come up on implementation of the OIOS, such as reduction in the number of tour parties etc.)

            We request all the Units to give their comments on this important presentation so as to enable the HQr present a comprehensive response to the proposal. Copy of the proposal are attached to this Circular.

Under Article 9 B of the Constitution of All India Audit & Accounts Association, it is here-by notified that the 48th Conference of All India Audit & Accounts Association shall be held at Kolkata, West Bengal from 5th November 2019 to 8th November 2019.

Note:

1. The Central Working Committee shall be held on 5th November 2019 at 11 AM at the venue of the Conference. The Central Working Committee meeting would be preceded by the meeting of National Executive Committee on 4th November 2019 at 5 PM.

 2. All the units should submit Audited Accounts for the years 2016-17, 2017-18 & 2018-19 and upto 30th September 2019 so as to reach the same at Head Quarter before 15th October 2019, enclosing therewith statement on the remittances to HQr. for the said period.

3. As per Note 2 under Article 9-B of the Constitution the voting rights shall be regulated on the basis of membership of each Federated Association in the following manner: two delegates for first 250 primary members and one delegate for each additional 250 members and one for the last fraction of 250 memberships. This shall be decided on the basis of remittances towards Head Quarter quota for the period 2016-17, 2017-18 & 2018-19 and upto 30th September 2019.  

4. The Members of the outgoing National Executive Committee shall be delegates as per the Constitution.

5. There shall no limit on the number of observers. Observers shall not have voting rights. (This would be subject to any restrictions that host Unit would like to propose).

6. The names of delegates and observers should be communicated to HQr by 15th October 2019 with a copy to Reception committee.

7. The quorum for the Conference shall be 33.33% of the entitled delegates, subject to 35% of Federating Associations participating. For adjourned meeting, there shall be no need of quorum.

8.  Any Federating Association wanting to move any resolution on Departmental or Common Front of CG employees or on any issue shall have to send the resolution to the Head Quarters of the Association by 1st October 2019. Resolution(s) other than the one sent in advance as stated above shall not be entertained and be summarily rejected. 

9. The Reception Committee shall communicate the details such as Venue, Delegation/observer Fee etc.

10.  Federating Association shall have to make their own arrangements for to and         fro journey.

IMPLMENT CONFEDERATION CALL FOR NATION WIDE STRUGGLE

            Confederation has called upon all affiliates to submit a memorandum on charter of demands to the Hon’ble Prime Minister by holding lunch hour meetings in all workplaces on 5th September 2019. As per the call, the memorandum is to be submitted through proper channel.

            This programme of submission of memorandum to PM is to be followed up by mass dharna in front of important offices and at all major centres in the state/district.

            We endorse the calls and call upon all our Units to implement the call without fail. Report on implementation of the programmes may be sent to the HQr.

Dear Comrades, National Secretariat meeting of the Confederation of Central Govt. Employees & Workers held at New Delhi on 04-07-2019, after reviewing the entire scenario prevailing in the Central Government Employees sector, has decided to organise phased programme of action for settlement of the long pending demands of the Central Government Employees and Pensioners. The “Big Bang” neo-liberal reforms that are being unleashed by the BJP-led NDA Government has seriously jeopardised the job security, wage security, social

security and Trade Unon rights of the Central Govt. employees and other sections of workers in general. Our efforts to organise joint programme of action of all Central Govt. employees (including Railways and Defence) under the banner of NJCA has not yielded positive response from the dominant leadership of the NJCA. All the Defence employees Federations have joined together and given notice to Govt. for one month long definite strike from 20-08-2019 to 19-09-2019 demanding withdrawal of the move to corporatise/privatise Ordnance Factories. Eventhough the major Railway Federations viz; AIRF & NFIR has not yet given call for serious agitational programmes against the proposed move of the Government to Corporatise/Privatise Railway Production Units (Coach factories etc.), closure of Railway Printing Presses and introduction of private passenger trains in selected routes through Public Private Partnership (PPP), all other Unions/Associations like All India Loco-Running Staff Association (AILRSA), Guard Council, Dakshin Railway Employees Union (DREU) etc. had already given call for nationwide agitational programmes. All the Central Trade Unions (except BMS) has also given call for joint protest demonstrations and Rallies against the anti-worker labour law reforms and privatisation spree of the Modi Government. Confederation of Central Govt. Employees and Workers, being a part of the mainstream of the working class of our country, shall join all the programmes announced by the Central Trade Unions. Further National Secretariat has decided to extend full support and solidarity to the struggles of Railway, Defence, BSNL employees and the agitational programmes conducted by the affiliates of Confederation. Confederation calls upon all the Affiliated organisations and State/District level C-O-Cs to organise the above mentioned two phased agitational programmes on 5th September 2019 and 15th October, 2019 and conduct campaign programmes among all Central Govt. employees to educate them on the impending dangers of the neo-liberal reforms vigorously pursued by the NDA Govt. and be ready to jumb into higher form of trade union action, if situation warrants. Wide publicity may be given through print, electronic and social media. Confederation’s 10 point charter of demands is enclosed to this circular. Next course of action will be decided by the next National Secretariat meeting scheduled to be held in October/November 2019. Sub: Memorandum on the long pending demands of the Central
Government employees - Request for kind intervention -
regarding.
This Memorandum is submitted with the most fervent hope that the Hon’ble
Prime Minister will be condescend to intercede on our behalf to settle the following
long pending issues agitating the minds of 32 lakhs Central Government employees
and 33 lakhs Central Govt. Pensioners.
1. Scrap New Contributory Pension Scheme (NPS) and restore Defined
benefit Old Pension Scheme (OPS). Guarantee 50% of the last pay drawn
as Minimum Pension.
Government of India has implemented New Contributory Pension Scheme
(NPS) for all Central Govt. employees entering service on or after 01-01-2004.
When compared to the Old Defined Benefit Pension Scheme (OPS) there are
many adverse factors in the NPS. The monthly pension amount being received
under the Insurance Annuity Scheme under NPS is less than Rs.3000/- per
month, to those NPS employees who had already retired from service during
2018 and 2019, after completing 14 to 15 years of service, whereas as per the
Old Pension Scheme an employee who completes minimum ten years
qualifying service will get 50% of the last pay drawn as Minimum Pension which
in any case will not be less than Rs.12,000/- for a lowest level employee (Multi
Tasking Staff) with ten years service in Central service. Thus the very principle
laid down by the Hon’ble Supreme Court of India that “Pension is a social
welfare measure rendering socio-economic justice to those, who in the
hey day of their life ceaselessly toiled for the employer on an assurance
that in their old age, they would not be left in lurch”, stands defeated.

Seventh Central Pay Commission headed by Retired Justice of
Supreme Court Shri. Ashok Kumar Mathur, in its report made the following
observations about NPS:
“Almost a whole lot of Government employees appointed on or
after 01-01-2004, were unhappy with the New Pension Scheme.
Government should take a call to look into their grievances”.
Govt. appointed a Secretary level committee called “NPS Committee” for
streamlining the NPS, but that committee was not empowered to look into the
main demand of the NPS employees i.e., scrap NPS, restore OPS and
guarantee 50% of the last pay drawn as monthly pension. It is true that as per
the recommendations of the NPS Committee, Govt’s contribution to NPS is
increased to 14% from 10% and some other cosmetic changes are also made
in the NPS Rules. But the basic grievance still remained unattended and
unsettled, as a result uncertainty about the social security and Pension looms
large over the head of every NPS employee, and the discontentment among
the NPS employees (as correctly observed by 7th CPC) is growing day by day.
We request the Hon’ble Prime Minister to have a relook into the entire matter,
so that NPS will be scrapped and OPS will be restored and at least 50% of the
last pay drawn will be guaranteed under Rules as Minimum monthly Pension on
retirement.
2. Honour the assurances given by Group of Ministers on 30-06-2016 to
National Council (JCM) Standing Committee members regarding increase
in Minimum Pay and fitment factor recommended by Seventh Central Pay
Commission (CPC):
All the Federations/Unions/Associations in the Central Govt. Employees sector
including Railways, Defence and Confederation had given a call for nationwide
indefinite strike from 11th July 2016, demanding increase in Minimum Pay and
Fitment formula recommended by Seventh CPC and other 7th CPC related
issues. A goup of Cabinet Ministers including Shri. Rajnath Singh, then Home
Minister, Shri. Arun Jaitley, then Finance Minister, Shri. Suresh Prabhu, then
Railway Minister discussed the demands with the leaders of National Joint
Council of Action (NJCA) and assured that Minimum Pay and Fitment formula
will be increased and a High Level Committee will be appointed to submit
recommendations in this regard. The assurances were reiterated by Shri.
Rajnath Singh, then Home Minister on 6th July 2016 in the second round of
discussion and Finance Ministry issued a press statement confirming the
assurances. Accordingly, the proposed indefinite strike call of the NJCA was
deferred, taking in good faith the assurances given by the Group of Ministers.
We are sorry to bring it to the notice of the Hon’ble Prime Minister that even

after a lapse of three years, neither the promised High Level Committee is
constituted by the Govt. nor the Minimum Pay and fitment formula is increased.
The entire employees feel betrayed. We request the Hon’ble Prime Minister to
take immediate necessary action for implementing the assurances given by the
Group of Ministers.
3. Grant “Option-I Parity” recommended by the 7th CPC to all Central
Government Pensioners.
7th CPC has recommended a new formula called “Option-1” for refixing the
existing pension of Central Government Pensioners retired prior to 01-
01-2016. Government accepted the recommendation in principle and
constituted a Secretary level committee to examine and recommend regarding
the feasibility of implementing ''option-1'' recommended by 7th CPC. The
Committee was not, ready to heed the valid and scientific pleadings made by
the staff-side in favour of the recommendation mode by 7th CPC which is an
''Expert Body'' headed by retired Justice of Supreme Court, instead viewed the
case with a closed mind and gave recommendation to the Government that
implementation of Option-I is not feasible. Govt accepted the recommendations
of the Secretary Level Committee and rejected ''option-I'' recommended by 7th
CPC.
The entire Pension community is very much aggrieved of the decision of the
Government. We request the Hon’ble Prime Minister to review the case
dispassionately, so that the ''option-I party'' recommended by the 7th CPc will
be accepted by the Government.
4. Regularisation of Gramin Dak Sevaks working in Postal Department and
casual/contract workers working in all Central Govt Establishments.
(a) About 2.76 lakhs Gramin Dak Sevaks are employed in the Postal Department.
Govt. appointed a one man committee headed by retired Postal Board Member
Shri Kamalesh Chandra, to examine their wages and service conditions. The
final report submitted by the Committee includes certain positive
recommendations. As abnormal delay took place in implementing the
recommendations of the Report, the entire Gramin Dak Sevaks went on
indefinite strike for 16 days in 2018. Finally Govt issued orders, but many
recommendations are either modified, diluted or rejected, including payment of
arrears from 01-01-2016 as per the formula recommended by the Committee,
Children education Allowance, Promotions, etc, etc., We request the Hon’ble
Prime Minister to take a lenient view to rederess the grievances of the low-paid
Gramin Dak Sevaks which includes regularisation of their services and also
implementation of the pending positive recommendations of the Kamalesh
Chandra Committee report.

(b) There are thousands of causal/contract employees and workers engaged in all
Central Govt departments and working for years together. They are not paid
equal wages and not extended any benefits of regular employees. Even after
working for more than ten years continuously, their request for regularisation is
not considered favourably. There is no scheme to absorb them in regular
service. We request the Hon’ble Prime Minister to consider their case
sympathetically so that a scheme will be worked out to regularise all
casual/contract workers and extend them all the benefits of regular employees.
5. Stop Corporatisation/Privatisation of Railways, Defence and Postal
Departments. Withdraw the orders for closure/reorganisation of Govt. of
India Printing Presses, Geological Survey of India (GSI), Central Public
Works Department (CPWD), Salt Department, Stationery Offices etc.
The no holds barred big bang reforms unleashed by the Central
Government has given rise to an alarming situation in the Central Government
Departments. The proposed move to Corporatize Railway Production Centres
and allowing private passenger trains, Corporatisation of Defence Ordinance
Factories, Life Insurance and Parcel Sector of Postal department, closure of
Govt. of India Printing Presses, proposed reorganisation of Salt Department,
Geological Survey of India (GSI), Central Public Works Department (CPWD),
Stationary Offices etc. has put in danger the very existence of various Central
Govt. Departments and also the job security of lakhs of Central Govt.
Employees, Gramin Dak Sevaks and Casual/Contract Workers. The present
fate of the Telecom Department which was corporatized in 2000 into different
companies is a bitter lesson for all of us. We request the Hon’ble Prime
Minister to desist from the proposed move to corporatisation, privatisation,
closure and reorganisation of Central Govt. departments.
6. Filling up of seven lakhs vacancies existing in various Central Govt.
Departments:
As per the 7th CPC report (Annexure to Chapter-3) there are 7,47,171
vacancies in the Central Govt. Departments as on 01-01-2014. More
retirements has taken place after 01-01-2014 and now the figure may go upto 8
lakhs. During the period from 2001 to 2008, thousands of posts are abolished in
all Departments as per the downsizing orders issued by the Government in
2001. Only very few posts are filled up after 2014 and most of the Departments
are running with 30 to 40% shortage of manpower. This has resulted in heavy
increase in workload on the existing employees and has adversely affected the
efficiency of all Central Govt. Departments to a great extent. We request the
Hon’ble Prime Minister to take immediate necessary action for filling up all
vacant posts in all departments of Central Government.

7. Revision of Wages from 01-01-2016 and payment of arrears of pay and
Bonus from 2016 onwards to the employees of Autonomous bodies:
We regret to inform the Hon’ble Prime Minister ,that due to the stringent
conditions imposed by the Finance Ministry, the pay revision from 01-01-2016
and payment of arrears is still pending in most of the Autonomous bodies under
Central Government. Further they are denied Bonus from 2015-16 onwards.
We request the Hon’ble Prime Minister to take necessary action to redress the
long pending genuine grievances of the Autonomous body employees.
There are other issues also which is already submitted to the Cabinet
Secretary and the Heads of various Ministries/Departments earlier by us. We
are enclosing herewith a copy of the Charter of Demands containing the
important problems faced by the Central Govt. Employees and Pensioners.
Concludingly, we once again request the Hon’ble Prime Minister to be
sympathetic enough to redress the grievances mentioned in this memorandum
and enclosed Charter of Demands.

10 POINTS CHARTER OF DEMANDS OF CONFEDERATION
1. Scrap New Contributory Pension scheme (NPS). Restore Old defined benefit
Pension Scheme (OPS) to all employees. Guarantee 50% of the last pay
drawn as Minimum Pension.
2. Honour assurance given by Group of Ministers (GoM) to NJCA leaders on 30-
06-2016. Increase Minimum Pay and Fitment formula. Withdraw the proposed
move to modify the existing time-tested methodology for calculation of Minimum
wage. Grant HRA arrears from 01-01-2016. Withdraw “Very Good” bench
mark for MACP, Grant promotional hierarchy and date of effect from 01-01-
2006. Grant Option-I parity recommended by 7th CPC to all Central Govt.
Pensioners. Settle all anomalies arising out of 7th CPC implementation.
3. Stop corporatisation/privatisation of Railways, Defence and Postal
Departments. Withdraw closure orders of Govt. of India Printing Presses. Stop
proposed move to close down Salt Department. Stop closure of Govt.
establishments and outsourcing.
4. Fill up all six lakhs vacant posts in the Central Government Departments in a
time bound manner. Reintroduce Regional Recruitment for Group B & C posts.
5. (a) Regularisation of Gramin Dak Sevaks and grant of Civil servant status.
Implement remaining positive recommendations of Kamalesh Chandra
Committee report.
(b) Regularise all casual and contract workers including those joined on or
after 01-09-1993.
6. Ensure equal pay for equal work for all. Remove disparity in pay scales
between Central Secretariat staff and similarly placed staff working in field units
of various departments.
7. Implement 7th CPC Wage Revision and Pension revision of remaining
Autonomous bodies. Ensure payment of arrears without further delay. Grant
Bonus to Autonomous body employees pending from 2016-17 onwards.
8. Remove 5% condition imposed on compassionate appointments. Grant
appointment in all eligible cases.
9. Grant five time bound promotions to all Group B & C employees. Complete
Cadre Review in all departments within a time-frame.
10. (a) Withdraw the anti-worker wage/labour codes and other anti-worker Labour
reforms. Stop attack on trade union rights. Ensure prompt functioning of
various negotiating forums under the JCM Scheme at all levels.
(b) Withdraw the draconian FR 56 (j) and Rule 48 of CCS (Pension Rules
1972.
