Dear Comrades,
HQR QUOTA, AUDITLEKHA REMITTANCES

Statements on Head Quarter quota remittances and dues, remittances of
special fund and remittances and dues on Auditlekha are attached
herewith. The dues prior to 01-04-2009 have not been included. (If we
include that too it will be a mind blowing figure).

If the present state of affairs continues, functioning of head quarter
will be put into hardship.

All the units are requested to clear the head quarter quota dues and
Auditlekha dues at the time of CWC.

It will have to be decided by the CWC – if there is a failure to clear
the dues by any unit – whether to permit the unit to be permitted to
participate in the CWC meeting on 24-25 February 2011 at New Delhi.

Also the call for Special Fund has been responded to by very few
units. Units are requested to collect the special fund and remit the
same at the time of CWC.

ON 4 ADVANCE INCREMENTS

Please recall the discussion with DAI on 18th January 2011 on the
issue of implementation of the court ruling universally. DAI had
assured us that it would be done if there is no legal obstruction.

The order giving the benefit of 4 advance increments on passing the
departmental confirmatory examination to those Auditors who passed the
DC examination between 1973 and 1981 has been issued by CAG office.
Wide publicity may please be given to this.

The replacement of qualification pay with 4 advance increments on
passing of DC examination will have to be taken to its logical
conclusion by vigorously pursuing it organisationally.

CWC – 2011
A brief note on agenda items is given along with this circular. All
units are requested to discuss the agenda items in their executive
committee and in the activists meeting, taking the opinion of the
general body meeting.

It will be the right thing to present the decisions arrived at
democratically in the organisational forum in a precise and concise
manner in the CWC meeting. Each unit is requested to make a written
presentation after presenting the views in the CWC as this will help
CHQ. This will also save a lot of time.
WOMEN'S CONVETION
The 1st Women's Convention under the aegis of Confederation of Central
Government Employees and Workers was held at Kolkata on 7th and 8th
February 2011. 19 comrades representing All India Audit & Accounts
Association participated in the Convention – in addition to comrades
from West Bengal. (Quota for the Association was 15). Kerala-1, Tamil
Nadu (Chennai)-6, Karnataka (Bangalore)-5, Maharashtra-Mumbai-2,
Orissa (Bhubaneswar)-1, Himachal Pradesh (Shimla)-4.

Com Ninakumari Kujur, Chairperson, Women's Committee, All India Audit
& Accounts Association was one of the members of the Presidium of
Convention. Comrade Narmada, Madras Civil Audit Association, Chennai,
Com VB Aruna, Audit & Accounts Association, Kerala and Com Premalata
Ramaswamy, Audit COC, Mumbai spoke in the Convention.

Women's Committee with Com Geeta Ghoshal (Organising Secretary,
Confederation – ITEF) and Com Shobhana (NFPE - Kerala) have been
elected as Chairperson and Convener respectively. Comrades Ninakumari
Kujur, Narmada and Devki Devi (HPCAA, Shimla) are elected to the
Committee from All India Audit & Accounts Association.
JAC
JAC circular 01-2011 is attached. All units may take necessary steps
to revive JAC and observe the programme given.

Dear Comrades,

At the very outset, wish you all a very happy and prosperous New Year
2011. Our New Year resolution should be, on priority, getting the
resolution on rejection of arbitration award on grant of parity in pay
scale with central secretariat called back from Parliament and getting
the award implemented.
Reports receiving from the field formations of the constituent
organisations indicate that the non implementation of the award and
the move of the government to reject it is not generating sanction –
and hence action – as it should. Many reasons are cited by many a
comrades. The common refrain is that the direct beneficiaries of the
arbitration award who are still in service are getting dwindled day by
day.
There is a failure on the part of the leadership in educating the
mass of employees on the adverse impact of the rejection of the
arbitration award on grant of parity in pay scale with central
secretariat.
One should remember that irreparable damage has already been caused
to our demand for parity in pay scale with Assistants of CSS by the
simple action of certain misguided colleagues knocking the doors of
judiciary and the Supreme Court knocking out the demand in the
expected lines.
The sixth CPC has also not done what was expected of it – stating
that, relying on the Supreme Court judgement rejecting the parity with
Assistants of CSS, parity has never been accepted by the government.
Though the SCPC gave the same grade pay to both SAs and Assistants,
the Assistants have again manipulated to be at a higher grade pay,
against the very recommendation of the SCPC.
The award given by the Central Board of arbitration in 2004 granting
parity in Pay scale to SAs of Audit & Accounts with Assistants of CSS
from 1.1.1986 is the basis for the demand of audit and accounts
fraternity for the parity with Assistants of CSS – with judiciary
going against us.
If the Parliament also rejects the concept of pay parity with
Assistants of CSS by the rejecting the arbitration award, the result
would be that forever the audit and accounts personnel would have to
be at a lower pedestal in the pay hierarchy vis-à-vis Assistants of
CSS.
Let us remember that audit and accounts employees achieved the long
pending demand of pay parity with Assistants of CSS in 1984/1987 and
also in 2003 not through judicial process, but through negotiations
backed by sustained agitation.
The story is not different today. It should be our endeavour to
defeat the forces that are working against the interests of audit and
accounts fraternity – in and out. For that a strong movement is to be
built up, the local JACs will have to be functioning and active.
The local MPs should be contacted and they be persuaded to write to
the Finance Minister calling upon him to recall the resolution and
implement the award given by the Central Board of Arbitration in CA
ref No 03/2001.
Keeping in mind that any laxity in mobilising the membership and the
MPs of your area would be suicidal for the cause of audit and accounts
personnel for ever to come, the Apex JAC appeal to every one of you
plunge into education and mobilisation of Members of the Association
simultaneously trying to enlist the support of the Members of the
Parliament.

AWAKENING DAY ON 15-02-2011
The Apex JAC calls upon every constituent and its field formations to
observe 15th February 2011 as "AWAKENINGDAY" by holding lunch-hour
demonstration in each office and adopt the enclosed resolution. Copy
of the resolution may please be forwarded to Apex JAC as well as to
the CHQ of each constituent organization.

APEX JAC MEETING
It has been decided that, apex JAC shall meet at AGCR Building, ITO
New Delhi on 22nd February 2011 at 3.P.M. to review the latest
situation and decide about the future course of action.

All Chief Executives of constituent organizations of apex JAC are
requested to attend the meeting without fail. However, formal notice
for the meeting is being issued separately.

This general body meeting of the …….Association held on 15th February
2011 having deliberated in detail the adverse impact of the move of
the government to reject the award by the Central Board of Arbitration
in CA ref No 03/2001 here-by commit themselves to launch vigorous
campaign amongst the audit and accounts employees for joining the
struggle for parity in pay scale with Assistants of CSS and grant of
higher pay scale to audit and accounts cadres maintaining vertical
relativity.

This meeting further resolves to mobilise the Members of the
Parliament of the state/station in support of the implementation of
arbitration award in CA reference No 3/2001, granting pay parity with
Assistants of CSS.

CWC AT NEW DELHI
Hope all would have be in receipt of the notification for the CWC
meeting at New Delhi on 24th and 25th February 2011. The venue of the
CWC meeting shall be Gandhi Peace Foundation Hall, DDU Marg near ITO.
Accommodation has been arranged at Garhwal Bhavan for 24-25 Feb 2011.

HQr Quota: All the affiliates should clear HQr quota upto and
including 31st December 2010 failing which they shall not be
entitled either as delegate or observer.
Auditlekha Dues: Remittances are very poor. All Units shall have to
pay up all the dues on this head upto 31st Dec 2010.
The unit wise dues on both the heads will be circulated separately.
Special Fund : Very few units have responded to this call. All may
remit the special fund collected at the time of CWC meet.

WOMEN'S CONVETION
Good number of units has informed about the participation of
representatives from their unit in the Convention at Kolkata on 7-8
February 2011, but some are still lagging even in informing about the
factual position.

All the units are requested to depute women delegates as per the
quota given vide circular 32-2010.

Dear Comrades,
The present day political and economic developments in the nation
such as of rocket rising prices of essential commodities and
insecurity in day to day life demand that the women have to come
forward and take up the challenges head on.
The responsibilities of women have increased both in the domestic
front and the official front. It is the women who have to see to it
that there is economy in usage of all facilities like electricity,
water, food grains etc. and on the other hand women have to be in the
forefront of all struggles for basic rights and to redefine lives to
find more space in society free from violence.
Women's organisations are growing and getting a say in every activity
on earth, but the involvement of women from each family must be
ensured- to join in the collective movement.
In India and all over the world the importance of unity among women is
very much necessary for obtaining social justice at all levels. As
long as there is no unity among women, injustices against women will
continue.
Thus to live in peace free from fear and to ensure security for our
children and ourselves we must unite and fight for our rights.
The IA&AD is in the lime light with more importance in the present
political scenario and this is also the time for us to act to support
the good cause and assert our righteous position.
The Women's Convention being held at Kolkata on 7th & 8th February
2011 under the aegis of Confederation of Central Govt employees and
Workers is the first step in this direction to organise the women work
force in the various offices under the central government.
Let us meet in the Convention to discuss and deliberate our present
position updating information from all the units and also from other
organisations and chalk out a programme for the healthy advancement of
our official and domestic lives.
Subsequently we would be organising a Women's Convention under the
banner of our Association.
I appeal to all Units to the participation of women comrades in the
Convention at Kolkata on 7th, 8th February 2011.

March 8th - International Womens Day

Let us remember the legacy of struggles for democratic rights of the
working class while preparing to observe International Womens Day on
March 8th 2011. This is the time for revitalizing our energy to
prepare for a sustained struggle on various legitimate demands.
We have to strengthen our organisation take up issues and develop more leaders.
There is no alternative to struggles.
Let our main objectives this season be:-
1. Increasing participation of women in both local and national level meetings.
2. Educating and persuading women to play an effective role in trade
union so that they can exercise pressure in the society and create
awareness about human rights and fundamental freedom.

MEETING WITH DAI

We had a meeting with DAI yesterday, ie 18th January 2011. The
Association was represented by Coms M Duraipandian, President, Subhash
Chandra Pandey, Vice President and V. Nageswara Rao, Additional
Secretary General in addition to the Secretary General. PD, Staff, AC
(N) and AO/JCM also attended the meeting.

A brief on the discussion is given below.

1. Replacement of Qualification pay with four advance increments

DAI stated that the question of granting four advance increments to
all for the period 1973-1981 would be considered provided there is no
legal issue involved.

As regards re-introduction of the scheme for future DAI informed that
a scheme withdrawn by CPC cannot be reconsidered. But Association is
free to raise it as a fresh item at a later stage.

2. Permission for AAO (Adhoc) to negotiate incentive exam

DAI agreed to examine the issue in the light of provisions in MSO/Admn.

3. Simplification of syllabus for information Technology (Theory) for
SAS and incentive exam

The Association requested for relaxation as a one time measure.

DAI stated that he would look into the issue and asked the Association
to submit a detailed note on the subject.

Association requested for extension of the waiver of results of the
paper Statistical sampling for the year 2009 to 2008 also. This was
not agreed to.

4. Grant of incentive to Accountant/Auditor & SA for discharging the
duties of DEOs
DAI stated there can not be any uniformity on the additional work.
Where ever there is additional work, honorarium could be paid. This
has to be decided by the concerned Accountants General.

5. Stoppage of transfer on tour basis in NE Region offices.

DAI stated that in the scenario of shortage of man power and own cadre
in these newly created offices the transfer on tour is the (second)
best option available. He agreed to consider if Association submits
any alternate proposal.

6. Declaring SOGE (A&E) –common paper- passed candidates as promoted

DAI asked the Association to submit a detailed note on the subject.

7. Stop intervention in the day to day functioning of the Associations
and extension of functional facility.

After hearing the Association DAI assured to do the needful.

SIGNATURE CAMPAIGN

Hope that by this time all the units might have completed the
signature campaign on the issue of grant of four advance increments.
Those who have not yet submitted the memorandum to the Accountants
General for onward transmission to CAG may please do it without any
further delay.

All Units may please send a copy of the signature campaign to CHQr.

WOMEN'S CONVENTION

Few units have communicated on the participation of women comrades in
the convention at Kolkata on 7-8 Feb 2010.

All the units may please ensure that they send their representatives
for the convention without fail. CHQ may be informed of the details of
the delegates attending the Convention without any further delay. Any
delay in communication would cause difficulties for the host unit and
inconvenience to the participants.

PARILAMENT MARCH BY WORKERS

All the units are requested to mobilise the cadres for the parliament
march on 23rd February 2010 at New Delhi. All Units may take lead in
mobilising the CG employees of the station under Confederation for the
Rally.

FIRM UP ONE'S RESOLVE

The year 2010 had been quite hectic; one cannot say that the year
2011 could be something different.

We had a militant action expressing strong disapproval of
high-handedness of the amoral IA&AS bureaucracy and their total
inaction on the prime concerns of the employees and officers. The
action of mass casual leave on 8th April 2010 was unique in many ways
– for first time every one in the department joined together and
conveyed their vehement resentment over the manner in which the basic
human rights are violated and the status and stature of the department
is eroded. Also, it exposed the administration's colonial mindset,
their inherent intolerance.

Many amongst us feel dejected because after the successful mass
casual leave programme when the administration behaved in a most
uncivilised manner we offered an apology or something of the sort to
get out of the situation.
History is witness that before incivility, civility has to take a
step back - many a time. When we decide to take a step back, it is not
surrendering – it is only a tactical withdrawal to regroup and
strengthen ourselves for the furtherance of future struggles.

There is no defeat in the history of working class struggles, there
are only set backs. And we will rectify the mistakes and go to the
mass of employees to advance the struggle in furtherance of our avowed
goals. Every struggle advances cause of the workers.

Negotiation backed by agitation is our guiding principle; we want
peace but a reciprocated one. We cannot remain silent when certain
officers run amuck like wild bulls in the market and those vested with
authority to correct of the situation play the role of biased umpires.

The vacancy position in the department is getting acute; the present
policy of recruitment (if at all there) has to undergo a thorough
change. We will have to be prepared to face the situation that would
emerge after the cadre review that may come any time now.

On the Common Front of CG employees we can say that nothing happened
for eleven months – and in the 12th month, realising that expecting
the manna to fall- i.e. the dominant leadership amongst the CG front
to rise to the occasion and confront the government on the basic
issues - is a futile one, the Confederation decided to go it alone.

There has been no negotiation on any of the issues, the anomaly
committee – as the name is, that itself is an anomaly – has no meeting
and in the past two years when it met twice no issue was settled. The
attempt to de-link the grade pay from pay is moving fast.
After 3 years the National Council, JCM met in May 2010 with an
agenda submitted three years back. And nothing thereafter.
The staff side in the JCM is a mute spectator.
The Confederation has taken up the cudgel on behalf of all. It is for
one and all of us to rise to occasion and mobilise every segment of
government employees spreading the message even to those sections
where the leadership have ceased to be trade unionists.

The national scenario is quite grim. Corruption has spread to all
spheres of life. The corrupt few decide the destiny of others.

The life of the common man gets harsher and harsher with prices of
all essential commodities sky rocketing on each passing day. The
assured income is getting eroded. The number of those with assured
income also becoming lesser and lesser with more and more
contractorisation of all kinds of jobs in every sector.

Selling of the national properties to few selected corporate houses
is the priority of the present day government.

The government does not have money to implement the arbitration
awards in favour of Central government employees including the award
on parity in pay scales; but has no problem in writing off taxes
amounting more than 8 lakh crores of rupees favouring few hundred
corporate houses terming it revenue foregone!

One has to rise against all these.

The struggle has to be against these policies. The denial of trade
union rights, attack on the basic rights of workers – including
putting those fighting for basic human rights for the poor behind bars
on trumpetted charges of sedition - are natural corollaries of these
policies.

We have to be a part of the struggles against these policies to be
effective in our struggle to protect ourselves against victimisation.
There are no short cuts.

Dear Comrades,
The programme given vide Circular 31-2010 for observance of 22nd
December 2010 as 'Replace Qualification Pay with Four Advance
Increments (on passing of departmental examination) Day' has evoked
good response, as per the reports so far received at Head Quarters.
As stated in Circular 31 the second stage of the campaign for
replacing the qualification pay with four advance increments is to
start from 3rd January 2011 – signature campaign week..
All the units may take steps for effective campaign for the
successful implementation of the signature campaign from 3rd January
2011 to 7th January 2011. The format for the signature campaign is
given elsewhere in this circular.
MEETING WITH DAI
Meeting with DAI will be on 18th January 2010. We have submitted the
following agenda items for discussion (vide letter No AIA/B-1/81/2010
date 24th Dec 2010).

CWC MEETING
Notification for CWC meeting has already been dispatched. The venue
shall be Gandhi Peace Foundation Hall near ITO. Accommodation has been
arranged at Garhwal Bhawan for 24th & 25th February 2010.
Accommodation for 23rd Feb could not be arranged because central
trade unions have already booked all available accommodation in Delhi
for the Parliament March on 23rd February 2010.
WOMEN'S CONVENTION
The Women's Convention being organised by the Confederation would be
held at Kolkata on 7-8 Feb 2011. (Circular 32-2010)
All Units may intimate the HQr of the number of women delegates being
deputed for the Convention with their names and details of arrival.
Kindly remember that COC WB has to be intimated about the number of
delegates etc not later than 10th Jan 2011.

The High Court of Madras in their judgement dated 30.12. 2007 in writ
petition No 13258 of 2003 (Union of India & others vs. A Palanivel &
others have upheld the order of 20.11.2002 passed by CAT Madras Bench
made on OA No 229 of 2002. The Supreme Court of India has dismissed

According to this judgement, all auditors on passing the Departmental
Confirmatory examination may be granted 4 advance increments.

Since this is a judgement in rem, it is requested that it may be
implemented in respect of Auditors and Accountants of IA&AD.

It is further requested that 4(four) advance increments replacing the
existing qualification pay may please be granted to all
auditors/accountants from the date following the date on which they
have qualified in the departmental confirmatory examination.

It is here-by notified, under Article 9 D of the Constitution of All
India Audit & Accounts Association, that the Central Working Committee
of All India Audit & Accounts Association will meet at New Delhi on
24th & 25th February 2011 to transact the following business.

Agenda

1. To consider developments in the Departmental Front and to decide
future course of action there-of.

2. To discuss organisational front and to take appropriate decisions there-on.

3. To consider developments in the Common front of Central Govt
Employees and to take decisions there-on.

4. Any other matter with permission of Chair

As per Article 9 D of the Constitution only one delegate per
affiliated Association can attend the CWC meet.

All the affiliates should clear HQr quota upto and including 31st
December 2010 failing which they shall not be entitled either as
delegate or observer. .

The venue of the CWC meeting shall be Gandhi Peace Foundation Hall,
DDU Marg, Near ITO, New Delhi.

Delegation fee of Rs 400/- shall be charged per delegate/observer.

Article 9D - CENTRAL WORKING COMMITTEE: The Association shall hold
Central Working Committee Meeting, at least once in a calendar year,
represented by the Central Executive Committee Members of the
Association and one delegates from each of the Federating
Associations. The Secretary / General Secretary of the Federating
Associations shall be delegates to the Central Working Committee
Meetings. However, if the Secretary/ General Secretary, for any valid
reason, shall be unable to attend CWC meeting, he/she will nominate
any other representative as delegate. The representative so nominated
by the Secretary/ General Secretary of the Federating Association has
to be an office bearer of the Federating Association and shall have to
produce authority letter of nomination from the natural authorized
delegate i.e. Secretary/ General Secretary.

Dear Comrades,
In late 1950s and 1960s the All India Audit & Accounts Association
was functioning from a rented accommodation. In the second half of
1960, an organisational decision was taken to have own accommodation
in Delhi and the funds were raised. But the situation after the one
day strike on 19th September 1968 forced the organisation to spend the
amount raised for own building to meet the exigency of victimisation.

Then it was in 1986, when Com: CSV Warrier was the Secretary General,
the Association once again started working for having own
accommodation. Com Warrier applied for a plot under Ghaziabad
Development Authority. Another application was made in the name of Com
SK Vyas (the then President of the Association) also. A plot was
allotted in the name of Com Warrier, in the draw of lot that followed,
at Kaushambi just inside Ghaziabad – few yards away from Anand Vihar
ISBT.

By the time the allotment materialised Com Warrier had relinquished
the post of Secretary General and Com SMA Jinnah had taken over as
Secretary General. The other formalities were completed and the plot
was acquired during the time of Com Jinnah. Com Warrier was insisting
on transferring the title deed of the plot and formation of trust
which somehow dragged on.

The construction of a building did not materialise for many reasons
and the cost went escalating. By the time, in 1994 the UP Housing
Board came up with another scheme of ready built houses for
residential purposes in Vasundhara, Ghaziabad. The All India Audit &
Accounts Association decided to apply for one house. As per the
Ghaziabad Development Authority condition the organization could not
apply for allotment of the House. Hence, it was decided to submit the
application for allotment of house in the name of the then secretary
general, who happened to be Com A.B. Sen and it was decided that the
application would be made in the name of AB Sen, the then Secretary
General. With the help of CITU, we could get the house allotted in the
name of AB Sen, the then Secretary General. The National Executive
took the appropriate decisions which were subsequently ratified by the
Working Committee. For this purpose a call for raising the building
fund was given to all the affiliated units, which was hugely responded
by the units. The funds were raised and the payment was made. Thus the
All India Audit & Accounts Association had its own head quarter at
House No 1089, Sector 15, Vasundhara, Dist. Ghaziabad.

Simultaneously, the Association decided to buy one more house, ie the
adjoining one -1090- from CITU which was allotted in the name of Com
MK Pandhe and to meet the expenditure, it was decided to dispose off
the plot allotted and acquired in the name of com Warrier. The
decision was communicated to Com Warrier and he – who had a massive
heart attack by the time – complied with the organisational decision
and authorised the then Secretary General AB Sen through a power of
attorney to execute the sales deed.

In December 1995, Com MK Pandhe inaugurated Auditlekha Bhawan at
15/1089-1090, Vasundhara, Ghaziabad, UP and from 1997 the All India
Audit & Accounts Association started functioning from there.

But the formal transfer of the houses to the Association remained to
be done. It was only after 2004 the process of completing a legal
mechanism so as to enable transfer the houses to the Association were
seriously pursued. After continuous discussion and the persistent
efforts of the National Executive Committee, constitution for a Trust
was approved by the Special Conference in October 2008. The trust -
named after Com CSV Warrier – was registered in January 2009.

The National Executive Committee has been consistently pursuing the
transfer of both the houses to CSV Warrier memorial trust since then.
Com MK Pandhe transferred the house no 1090 to CSV Warrier Memorial
Trust on 11th January 2010.

Com. AB Sen had assured to a delegation of NE that he would transfer
the house once Com Pandhe transfers the house 1090. But the efforts of
the NE members did not succeed even after Com. M. K. Pandhe
transferred the building. Com Nageswara Rao, Additional Secretary
General of the Association, who was authorised by the NE to discuss
with AB Sen, reported to the National Executive Committee in August
2010 that his efforts are not being responded to properly by Com AB
Sen.

As AB Sen had been keeping away from the All India Audit & Accounts
Association and of late been seen with disruptors of audit and
accounts movement, Secretary General requested Com S Radhakrishna, who
was member of the National Executive between 1986 and 1997 and was
also Vice President of the Association during 1989 – 1997, to talk to
AB Sen so as to facilitate the transfer of the house to CSV Warrier
Memorial Trust.

Com Radhakrishna had four rounds of telephonic talk with AB Sen and
finally reported that talks with AB Sen has not yielded the desired
result on transfer of the house. In the meantime an e-mail has been
received from AB Sen stating "vacate my house immediately" (Copy
enclosed). The copy of the e-mail on summary of Com Radhakrishna's
talk with AB Sen is enclosed (with the consent of Com Radhakrishna).
The e-mail is self explanatory. Copy of the letter the Association
addressed to AB Sen is also enclosed.

This may please be reported to the Executive Committee, the activists
and the general membership.

Com Radhakrishna's letter
Dear Com Raja

I am writing this letter to put records straight regarding the
background and reasons which prompted me to open a dialogue with Com
Sen regarding the property of All India Audit & Accounts Association
located in the 'Vasundhara', Ghaziabad. As you are aware I was a part
of National Executive when both house dwellings in 'Vasundhara'
Ghaziabad where our Hqrs is located at present was purchased and also
had participated in the inaugural function of the building as Vice
President of the Organisation. To meet the conditions of Ghaziabad
Development Authority the NE at that time had taken a decision to
purchase the dwellings in the name of Com Sen and Com Pandhe. The main
source of funds for the purchase of these houses came from the
contributions made by membership all over the country and the extra
realisation of amount we had made by selling of a plot which the
organisation had purchased earlier in the name of Com Warrier then
Secretary General. I have a longing desire that the properties which
was in the name of the individuals must be transferred to the
organization. Now as the Organization in the name of 'Com Warrier I
felt that transfer of properties to the Trust should be completed at
the earliest.. I was also happy when property in the name of Com
Pandhe was promptly transferred. When we along with President Com
Dorai Pandiayan met in Delhi during last week of October 2010 you had
mentioned about some hurdles you are encountering in the transfer of
property which the organization had purchased in the name of Com Sen.
As I had worked with Com Sen in the National Executive and was also
being a party to the decision making process of the organization at
that time I felt whether I could be of any help in removing those
hurdle. You permitted me to go ahead and have a talk with Com Sen.
Based on that clearance I opened a dialogue with Com Sen. After some
initial exchange of views I could understand that some of the claims
of Com Sen even after a lapse of three or four years after his
demitting the office had not been settled. He had also a feeling that
he is being humiliated and being treated shabbily. Based on those
talks when I contacted, you told me that even today he highly
respected by the Organisation and personally by you also. You
clarified that there is only a difference of opinion on certain
perceptions. However I did not go into that issue and only wanted
settlement of the dispute regarding the claims of Com Sen. After this
as promised you had forwarded me the Claims preferred by Com Sen and
Auditors report on those claims. In fact the mail sent by you was
forwarding of the reply you had mailed Com Sen in 2008. After going
through the same I felt instead of going into entire thing there
should be a way out for solving the issue. Considering that Com Sen
had lead the organization for more than a decade as Secretary General
& President and also the sacrifices he had made for the organisation I
felt that this issue to be settled without much heat and light. With
confidence of convincing you, few days back I had made an offer to Com
Sen stating that "I will request Com Raja to settle your claims of
above Rs.4lakh without any interest and he should agree to transfer
the property to the Organisation without any hurdles". The methodology
I had suggested was that you will prepare the cheque in the name of
Com Sen for the entire amount and will be deposited with a person in
whom both Com Sen and you had confidence and the cheque will be handed
over to Com Sen simultaneously with his transferring of property. For
that Com Sen had responded that he requires some time to think about
the proposal and also he would like to discuss with Com Prabhakar
former Finance Secretary of the Organisation. Therefore after few
days gap I contacted Com Sen yesterday (15.12.2010). Com Sen said that
after taking the opinion Com Prabhakar he has come to conclusion that
my proposal is not acceptable to him. He had made lot of sacrifices
for the sake of Organisation already and asking him always to make
sacrifice is not correct. Then I said if the issue is not settled
amicably it may lead to legal complications which are not good for the
Organisations and individuals concerned in the long run. For which he
responded that "what to do" and expressed his helplessness. If
required he is prepared to undergo the complications. Then I
concluded my discussions with him stating that "there is no further
use in my continuing discussions in the mater and I will withdraw from
further negotiations and inform Raja accordingly". He responded
"that's ok".
I have briefly narrated the entire conversations I had with Com Sen on
the matter and I would like to withdraw myself from further
interfering in this matter. Thank you for the confidence you had
reposed in me and I assure you that I am always available to make my
humble contribution at any time as worker of the Organisation. To put
the matter transparently I am forwarding the copy of this letter to
Com Sen for information.

Dear Comrade Sen,

Hope this letter will find you in best of health and high spirits.

As a very senior leader of our movement you are fully aware and
actually involved in realising the dream of the membership since 1960s
to have their own building for the All India Audit & Accounts
Association. In realising it concrete steps were taken by you as
Secretary General of the Association in mid-90s which resulted in
acquiring a dwelling unit (1089) under Vasundhara Awas Yojana in
Sector 15, Vasundhara, Dt Ghaziabad (UP) in National Capital Region
(NCR). Again it is because of your vision our Association acquired
adjacent dwelling unit (1090) which was allotted in the name of Com
M.K. Pandhe.

But for certain legal issues involved regarding registration of these
dwelling units in the name of the Association, you were forced to
register the dwelling unit 1089 in your name.

Now the Association has resolved the legal issues and a Trust – CSV
Warrier Memorial Trust – was registered in 2009.

The dwelling unit 1090 has since been transferred through a gift deed
(registered on 11th January 2010) by Com M. K Pandhe to the CSV
Warrier Memorial Trust.

The members of the All India Audit & Accounts Association always
remember you as a leader who realised the dream of having their own
building in the NCR. To complete their dream, legal formality of
transferring the property to the CSV Warrier Memorial Trust (of the
All India Audit & Accounts Association) has to be completed and I
shall be thankful if you can intimate your convenience to complete the
formalities so that the dwelling unit can be transferred at the
earliest to the Trust formed by the All India Audit & Accounts
Association.
