Dear Comrades,

 

            After a sustained struggle, in 2003, the audit and accounts employees under the banner of JAC of Audit & Accounts Employees Organisations could achieve parity in pay with Assistants in Central Secretariat maintaining vertical relativity. The parity was granted notionally with effect from 1.1.1996 and actually from 19.2.2003.

            Few members of All India Railway Accounts Staff Association (AIRASA) in Trivandrum (Shri Jose Sebastian and 4 others) challenged the decision of the Railway Board (ie Govt) to grant the higher pay scale from 19.2.12003 and demanded that higher pay (and subsequent arrears of pay) be paid from 1.1.1996, in the CAT, Ernakulam.

            CAT, Ernakulam, on 30.6.2006, quashed the order of Railway Board granting notional fixation from 1.1.1996 to 18.2.2003 and directed that the higher pay scale be paid in real terms with effect from 1.1.1996. The Railway board moved HC of Kerala against this directive of the CAT, Ernakulam. Finding no merit in the writ petition moved by the Railway Board, the HC of Kerala rejected the appeal (27.3.2012).

            Railway Board planned to move the SC. The petitioners (only three are still in service, other two have since retired), ie AIRASA filed caveat in the SC so that the SLP by the Railway Board is not admitted without hearing the original petitioners.  

            The case finally came up for admission on 25^th February 2013 and the SC rejected the SLP, rather the SLP moved by the Railway Board was not admitted – ie the CAT directive to pay arrears of pay from 1.1.1996 is upheld.

            There are two more cases filed by the AIRASA members – one at Patna, Bihar and Guwahati, Assam – which are  to yet to be disposed of.

            The case has come to finality. It is to be seen how the government would implement the directive of the court.

NE CALLS FOR SUCCESSFUL 2-DAY STRIKE ON 20-21^ST FEBRUARY

 

            The JOINT trade union convention, held at Talkatora Indoor Stadium in national capital on 4 September, 2013 by 11 central trade unions - CITU, BMS, INTUC, AITUC, HMS, TUCC, UTUC, AICCTU, AIUTUC, LPF and SEWA (Self Employed Women's Association) and several national federations of central government, state government, bank, insurance, central and state public sector workers and employees; industrial federations and independent local trade unions unanimously adopted declaration calling upon the working class for united action culminating in unprecedented 2 days General Strike on 20-21 February, 2013 against governments' neoliberal policies which are responsible for increasing attacks on their rights, lives and livelihood.

The demands on which the entirety of the Working Class would go on two day strike are:

1) Concrete measures to contain price rise

2) Concrete measures for employment generation

3) Strict enforcement of labour laws

4) Universal social security cover for organized and unorganized workers and creation of National Social Security Fund and

5) Stoppage of disinvestment in Central and State PSUs / Undertakings,

 

The National Convention demands immediate action by the Govt. of India to ensure:-

• No Contractorisation of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry/establishment.

• Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs 10,000/- linked with cost price index.

• Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

• Assured Pension for all.

• Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions Nos. 87 and 98.

The Secretariat of Confederation of Central Govt. Employees & Workers in its meeting on 4^th January 2013 called upon the central government employees to ensure massive success of the two day strike action for which call has been given by the Central Trade Unions and independent Federations.

Confederation reminded the employees of the historic strike of 12-12-12 and called upon to go for higher form of action by joining the two day strike on 20-21 February 2013. The Secretariat of Confederation decided that the demands raised during 12-12-12 strike to be added in the charter of demands in the strike notice that was served on Cabinet Secretary on 22-01-2013. Copy of the Strike notice served by Confederation is placed on the blog.

The National Executive Committee of the Association that met at Chennai on 1^st February 2013 called upon the Audit & Accounts Employees and Officers to join the 2-day strike on 20^th and 21^st February 2013. Accordingly, CHQ of the Association has served strike notice on CAG copy of which is enclosed. Units need not issue separate strike notices, but they may do so as part of mobilisation.

CHQ calls upon every personnel working in IA&AD to join the unprecedented and historic 2-day protest action by the entirety of the toiling masses of the country in a massive manner by striking work on 20^th and 21^st February 2013.

The charter of demands in pursuance of which the members of this Association would go on strike on 20-21^st February 2013 is attached.

CHARTER OF DEMANDS

 

PART – I

 

1. Take concrete measures to contain Price rise.
2. Take concrete measures for linkage of employment protection with the concession / incentive package offered to the entrepreneurs.
3. Ensure strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
4. Universal social security cover for the unorganised sector workers without any restriction and creation of a National Social Security Fund with adequate resources in line with the recommendation of NCEUS and Parliamentary Standing Committee on Labour.
5. Stoppage of disinvestment in Central and State PSUs.
6. No Contractorisation of work permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry / establishment.
7. Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs.10,000/-.

11. Revise the wages of the Central Government employees including Gramin Dak Sewaks with effect from 1.1.2011 and every five years thereafter by setting up the 7^th CPC.
12. Merge DA with Pay for all purposes with effect from 1.1.2011 including for Gramin Dak Sewaks.
13. Remove restriction imposed on compassionate appointments and the discrimination on such appointments between the Railway workers and other Central Government Employees.
14. [a] Departmentalise all Gramin Dak Sewaks and grant them all benefits of regular employees; End Bonus discrimination and enhance bonus ceiling to 3500/-; Withdraw open market recruitment in Postman / MTS cadre; Revise cash handling norms; Grant full protection of TRCA; Grant Time Bound Promotion and Medical Reimbursement facility etc.

[b] Regularise the daily rated, contingent, casual workers and introduce a permanent scheme for periodical regularization. Pending regularization, provide them with pro-rata salary at 6th CPC rates.

 

15. (a) Revive the functioning of the JCM. Convene the meeting of the Departmental Councils in all Ministries/Departments. Settle the anomalies raised in the National Anomaly Committee as also in the Departmental Anomaly Committees. Hold National Council meetings as specified in the JCM constitution. (b) Remove the anomalies in the MACP Scheme.(c) Grant recognition to all Associations/Federations, which have complied with the formalities and conditions stipulated in the CCS(RSA) Rules.
16. Fill up all vacant posts and creates posts n functional requirements.
17. Stop downsizing outsourcing, contractorisation, corporatization and privatization of Government functions.
18. Stop Price rise; Strengthen the PDS.
19. (a) Stop the proposal to introduce the productivity linked wage system; (b) discard the performance related pay structure; (c) introduce PLB in all Departments; (d) remove the ceiling on emoluments for bonus computation.
20. Revise the OTA, Night duty allowance and clothing rates.
21. Implement all arbitration awards.
22. Make the right to strike a legal and fundamental right of the Government employees on par with the other section of the working class.
23. A Grant Five promotion to all employees as is provided for in the case of Group-A services.
24. (a) Withdraw the PFRDA Bill. (b) Rescind the decision to allow FDI in pension sector;(c) Scrap the new contributory pension scheme (d) Extend the existing statutory defined pension scheme to all Central Govt. employees irrespective of their date of entry in Government service.
25. Vacate all Trade Union victimisations.

Details of arrival at Guwahati

 

            By this time, all the units might have booked the tickets for Guwahati, host station for 46^th Conference. The Reception Committee must be informed of the details such as date of arrival, number of delegates & observers etc. Last minute communications or any unit landing up at the venue without prior intimation would place the host unit in a very difficult situation, which would also put the visiting comrades into inconvenience. Every Unit must take it as a priority task.

 

No of Delegates

 

The Constitution of All India Audit & Accounts Association stipulates: 'Besides the National Executive Committee Members of the Federation, each of the Federating Association shall be entitled to send two delegates for first 250 Primary members and one delegate for each additional 250 members and one for last fraction of 250 membership.'

 

Membership means the number of members based on the HQr quota remittances for the years 20109-10, 2010-11 & 2011-12. The rate of HQr quota for the period is:

 

                        2009-10: Rs 4 per member per month i.e. Rs 48 p.a.

 

2010-11: Rs 4 per member per month for April-Sept and Rs 8 p.m. for Oct-March i.e. Rs 72 p.a.

 

                        2011-12: Rs 8 per member per month i.e. Rs 96/- p.a.

 

                        2012-13: Rs 8 per member per month i.e. Rs 96/- p.a.                       

 

HQr Quota remittances

 

Many a units are yet to remit the HQr quota fully as per the rate prescribed in the Constitution of All India Audit & Accounts Association. As stated in earlier Circulars, the delay in enhancing the rate of subscription cannot be accepted as the ground for not paying the HQr quota fully. If there is any delay in getting the approval or even moving the amendment, a special drive may be undertaken to clear the HQr quota dues.

 

Clear HQr Quota Dues by 15^th February 2013

 

The attached statement (not placed on the blog) will show how much is outstanding against the dues, unit wise. On 16^th February 2013, the statement would be updated.

 

The No. of delegates would be worked out based on the remittances received upto 15^th February 2012 and communicated.

CHQ WISHES ALL MEMBERS   A HAPPY & PROSPEROUS   NEW YEAR 2013

 

 

 

 

 

 

 

The year that went-by has left a lot of unfinished tasks before us. The first and foremost is the task of rebuilding the organisation.

 

One should realise that no outside forces can help us – the task has to be undertaken by us alone, confronting the odds, sometimes facing situations that none that In the present generation has ever faced.

 

We have to remember that nothing has come without costs – if we get DA today in every six as if on a platter, there is a history of sacrifices of our predecessors whom the leaders and members of the present generation would have never met. There were two strikes – in 1960 and 1968. It is after these the government was forced to refer it to the 3^rd CPC which for the first time recommended a formula for DA. This DA is a cushion that the government employees – though not really a hundred per cent – against the spiraling prices of essential commodities. Those who led and participated in those strikes would not have been the beneficiaries to the extent the next generation has been.

 

There is the story of struggle by Post & Telegraph workers way back in 1946 demanding wage hike, paving the way for the 1^st CPC.

 

The case of Bonus is fresh one – seven day long strike in October 1996 to end the discrimination on eligibility criteria.

 

The mayhem by the IA&AD bureaucracy is nothing new. It is through sustained struggles and sacrifices of our predecessors that we could assert our democratic rights, rather we could force the reluctant die-hard bureaucracy to concede space for democratic voice of the employees.

 

Today, the right to demonstrate is denied. Impediments are created in the regular functioning of the Associations. Rules are implemented in a most lopsided, rather one sided manner.

 

There is no short-cut – assert the rights, earn your space and make your voice heard, through struggles.  

 

Struggle is the right path,

 

Struggle is the only path.

 

CONFEDERATION ENDORSES THE 2-DAY STRIKE ON 20-21 FEBRUARY 2013

 

No organisation worth its name can remain mute to the miseries that are heaped on the people at large by the inhuman 'liberalisation' that take away your right for a decent and dignified existence.

 

The working class of the country would be going on two day strike on 20^th and 21^st February 2013 against these polices.  The unity of the Working class has grown with INTUC and BMS also joining the protest movement.

 

The Confederation has been a part of this joint Trade Union movement since its inception. So is the All India Audit & Accounts Association.

 

Let us prepare for the success of the strike.

 

CHQ GREETS THE STRIKING STATE EMPLOYEES OF KERALA

 

The state government employees of Kerala on indefinite strike from 8^th January 2013 against the decision of the state government to introduce contributory pension scheme with effect from 1^st April 2013 and also demanding, among other things, wage revision in every five year.

 

CHQ greets the valiant comrades of Kerala who are fighting against the new pension scheme.

Note:

 

1. The Central Working Committee shall be held on 10^th March 2013 at 4 pm at the venue of the Conference. The Central Working Committee meeting would be preceded by the meeting of National Executive Committee on 10^th March 2013.

 

 2. All the units should submit Audited Accounts for the year 2009-10, 2010-11 & 2011-12 to the Head Quarter so as to reach the same before 15^thFebruary 2013, enclosing therewith statement on the remittances to HQr. for the said period.

 

3. As per Note 2 under Article 9 of the Constitution the voting rights shall be regulated on the basis of membership of each Federated Association in the following manner: two delegates for first 250 primary members and one delegate for each additional 250 members and one for the last fraction of 250 memberships. This shall be decided on the basis of remittances towards Head Quarter quota for the period 2006-07 to 2008-09.

 

4. The Members of the outgoing National Executive Committee shall be delegates as per the Constitution.

 

5. There shall no limit on the number of observers. Observers shall not have voting rights.

 

6. The names of delegates and observers should be communicated to HQr by 15^th February 2013 with a copy to Reception committee.

 

7. The quorum for the Conference shall be 15% of the entitled delegates, subject to 25% of Federating Associations participating. For adjourned meeting, there shall be no need of quorum.

 

8.  Any Federating Association wanting to move any resolution on Departmental or Common Front of CG employees or on any issue shall have to send the resolution to the Head Quarters of the Association by 15^th February 2013. Resolution(s) other than the one sent in advance as stated above shall not be entertained and be summarily rejected.  

 

9. The Reception Committee shall communicate the details such as Venue, Delegation/observer Fee etc.

 

10.  Federating Association shall have to make their own arrangement for to and         fro journey.
