MEETING WITH DAI

The discussion on the agenda items - submitted by the Association vide our letter dated 20th August 2014 – with Ms Ajanta Dayalan, DAI took place today ie 19th November 2014.

The Association was represented by Coms M Duraipandian, President, V Nageswara Rao and KL Gautam, Additional Secretaries General and Anilkumar, Asstt Secretary General, in addition to the Secretary General. Ms Meera Swarup, DG/P, Shri Ranjit Singh, AC (N) and Shri ML Tamrakar, AO/JCM were present from the official Side.

The following is the brief of the discussion:

            1. Restructuring of IA&AD and audit/accounts cadres

i) The issue of manpower mobility and scope for uniform promotional avenues to all personnel irrespective of functional wing of the personnel was raised and for future, a unified office was proposed. The question of lack of versatility with accounts and audit (and vice versa) by the personnel in audit/accounts wings and its impact on the functional output was also pointed out.

DAI did not agree to the proposal of a unified office, pointing out “conflict of interest” when the same office finalises the accounts and then audit it, even though the grounds on which this was proposed was accepted as genuine. A lengthy discussion took place on the issue.

This item is raised and discussed for the first time. Constant pursuance of the issue backed by mass involvement would only ensure the authorities start thinking about it, leaving behind the out and out negative approach. As far as we are concerned, we would pursue the item further. We consider the ‘conflict of interest’ in an entirely different perspective.

As regards, lack of promotional avenues etc, DAI suggested that the Association make concrete proposals. The same can be discussed further with DG, Personnel and AC (N), which could be acted upon provided those proposals are falling within the power of CAG.
           
ii) We requested that CAG take necessary steps to rectify the deficiencies in the pay scales/Grade Pay such as GP 4200 to Auditor/Accountant, 4600 to SA and 5400 on completion of 4 years to AAOs. This alone would ensure justice to audit and accounts cadres from 7 CPC.

     DAI stated that no such action would be possible when the CPC is on the job; more over CAG cannot take such decisions independently of Deptt of Expr/FinMin. The only way is to go to 7 CPC with recommendations with strong footing – by the administration and the Association.

     We appreciated the memorandum submitted by CAG recommending total parity in pay scales for Audit & Accounts cadres with that of CSS.

     It was explained by the official side that the feeder cadre is being changed into Sr Auditor/Accountant with 75% Direct Recruitment of graduates. 25% of the SA cadre would be available for Auditor/Accountant on promotion. There shall be no recruitment in Auditor/Accountant cadre. The feeder cadre for Auditor/Accountant would be DEO -50% through seniority and 50% through exam. 

This would ensure that SA would be at par with Assistants as far as recruitment criteria is concerned, strengthening the demand for same pay scales. GP of 4600 in PB 2 is demanded for SA and GP 4200 in PB2 is demanded for Auditor/Accountant while 4800 in PB2 and 5400 in PB3 is demanded for AAOs.

We also raised the issue of adhoc AAOs and the promotion of deemed passed SAS personnel. DAI assured that the administration will examine the issues and try to resolve it.

2.  Approach to 7 CPC

This issue was not further discussed. We thanked DAI for most commendable recommendations and also for sharing of the memorandum with the Association.

3. Implementation of Court Directives in various cases

We raised the issue of many a judgements on various issues such as the pay scale, fixation benefit, MACP etc and its non implementation to all the personnel who are similarly placed.

We made specific references to the judgement of Chennai CAT on grant of GP 5400 on MACP to AAOs, the decision of the Controller General of Defence Accounts to implement the court directive on annulling the merger of SO/AAO between 1.1.2006 and 1.9.2008.

DAI stated that where ever the DOPT or Department of Expr is made a respondent, it is the government that decides on appeal. Further the term similarly placed is an ambiguous term lacking clarity. DOPT has already clarified that on issues where its orders are challenged, the right to issue orders vest with it. In the case of Chennai judgement, it was pointed out by the official side that in another case, no relief has been granted and Department has been asked to convey its decision in 6 week’s time. It was stated by DAI that there can be no blanket decision on not to go on appeal or the implementation of the judgement; it would be decided by case by case.

DAI suggested that other issues like victimisation etc which are not listed in the agenda as separate item be discussed with DG, Personnel and AC (N).

RESULT OF SUSTAINED STRUGGLE
It is to be understood that the decision of the CAG administration to demand the pay scale for SA cadre at par with Assistants and for AAOs with Section Officers of CSS is a step forward in our journey for achieving total parity.

In the existing system the recruitment is in the Auditor/Accountant cadre and then 80% is upgraded. In the proposed system 100% would be in the (proposed) upgraded pay scale. This is a major advancement.

We should remember that the sustained struggles that we launched for long including the Mass Casual Leave on 8th April 2010 have played a big role in making the CAG administration coming forward to make this proposal.

24 HOUR FAST DEFERRED

The proposed 24 hour fast on 26-27 November 2014 is deferred. The National Executive Committee meeting on 11-12-13 December 2014 would review the situation and then decide future course of action.

The Memorandum submitted by CAG to the 7th CPC on Group B and C cadres has formally been shared with the Association – which was mailed to all of you on 6th November 2014.

The memorandum, to put it modestly, is well drafted one, considerate to the aspirations of the personnel of IA&AD.

The salient features of the memorandum are:

            > LDC post be upgraded and granted the GP of 2400

            > Auditor/Accountant be granted GP of 4200           

            > SA be granted GP of 4600

            > AAO be granted PB2 -4800 and on completion of 4 years GP of 5400 in PB3

            > AO, GP 6600 and

            > SAO, GP 7600

> Stenographers – same pay scale for field offices and HQr office has been demanded ending discrimination

> Better pay scales have been demanded for EDP cadres

The Memorandum has given the following justification for higher pay scales:

In addition, there are recommendations on subjects such as lumpsum transfer grant, accommodation, Reimbursement of Children Education Allowance, Hostel Subsidy, LTC Facilities, Telephone/Internet / Mobile charges, Reimbursement of newspapers at residence, Daily Allowance/Travelling Allowance (DA/TA), Dearness Allowance and Honorarium which are by and large welcome.

By and large the memorandum submitted by the Comptroller & Auditor General of India, the topmost Constitutional Authority, has made a strong pitch for total parity in pay scales.
This strengthens our demand.
The proposal made by us and the JAC in our memorandum is a step farther – one more stage for Sr Auditor/Accountant and placing of AAO in PB2 and PB3, GP 5400. That is a new demand we have raised. The first stage towards moving to the improved demand is to get the parity that has being disturbed as and when we achieve it restored.

Submission of well prepared, reasonable memorandum or positive recommendations by CAG alone will not give us the parity and then further improvements. These have to be supported by mass actions. The agitational programmes with massive participation alone will ensure that the government (and the pay commission) will consider our justified demands and heed to our aspirations. The memorandum submitted by the CAG, ofcourse, strengthens our stand and struggles.

Strengthen the resolve to carry the struggle ahead; widen the base of the organisation; involve the members in every struggle; gain strength from struggles and strengthen the struggles.

OBSERVE 24-HOUR FAST
ON 26-27 NOVEMBER 2014
Dear Comrades

            The CWC meetings held at Shimla in 12-13 March 2014 and at New Delhi on 18-19 July 2014 decided to mobilise the rank and file on the Charter of Demands finalised and launch agitation in pursuance of the same. The CWC meeting at New Delhi decided to demand cadre restructuring in IA&AD and finalised the detailed proposals there-on.

            The New Delhi CWC decided to observe the following programmes which have since been implemented.

1.  Submission of the demand for restructuring of IA&AD by holding massive meetings and adopting the Restructuring Proposals on 20th August 2014

2. Moblisation Month – September 2014.

            The programme of submitting the cadre restructuring proposals on 20th August 2014 through mass meetings drew very good response across the country. The tour programme there-after has also been undertaken. Some of the visits could not be undertaken for unavoidable reasons. These are being filled in, in a phased manner.

            The third stage of the programme i.e. 24 hour fast by Unit leadership, had to be rescheduled on account of the festival season.

            The CHQ calls upon every unit to observe the programme of 24 hour fast on 26-27 November 2014. The fast shall commence at Lunch hour on 26th Nov and conclude on 17th November 2014, with mass meetings.

            The cadre restructuring proposals that we submitted to the CAG after the CWC meeting on 18-19 July 2014 will be discussed in the bilateral meeting with Dy Comptroller & Auditor General on 19th November 2014.

            All the units should conduct campaign amongst the membership on the Cadre restructuring proposals and the charter of demands as such – prior to the commencement of the 24 hour fast on 26th November 2014, ensuring massive participation on both days i.e. 26th & 27th November 2014.

            Updated version of the Charter of demands is attached. A brief on the Charter of Demands shall be issued separately.

 1. Immediate Restructuring of cadres in IA&AD and grant the following pay structure to audit & accounts cadres:
                       Auditor/Accountant – PB2, GP 4200
                  SA, Grade I               - PB2, GP 4600
                  SA, Grade II              - PB2, GP 4800
                  AAO Gr I                   - PB2, 5400
                  AAO Gr II                  - PB3, 5400 on completion of 4 years

         2.  Grant atleast 5 promotions in the career.
                         
   3.  i)  Fill Up all vacant posts through local recruitment
           ii)  Reassess the staff strength on scientific work norms
                                           
   4.  Permit Graduate MTS to negotiate SAS exam

   5. Re-designate DEO as Audit/Accounts Assistant; open up promotion chances for DEOs as Auditor/Accountant.   

    6. Ensure equal opportunity in promotion to stenos of the same station.

    7.  Restore transaction audit to the fullest extent.

    8. Strengthen Audit & Accounts to Safeguard People’s Rights
        Stop down-sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap              Curtailment/shedding of Audit functions in the name of Audit Plan; ensure  continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms; ensure effective Panchayati Raj Audit & Accounts by sanctioning adequate posts; revisit restructuring of Audit effected from 1..4. 2012.

         9.  a) Amend Company Law and DPC Act for Audit of Public Sector Undertakings &  Corporations even after reduction of Government share to below 50%.
    b) Amend Company Law to ensure the Audit by IA&AD of all Public Limited   Companies listed with Securities and Exchange Board of India (SEBI)
     c) Enact necessary law to bring audit of all public Financial Institutions by IA&AD.           

 10.   a)  Vacate victimisation of Association activists.
           b) Allow democratic functioning of Association without interference from   administration

11.    i) Withdraw annual audit criteria introduced vide letter dt 27 January 2011.
          ii) Stop unilateral implementation of transfer policy in Commercial Audit & P&T Audit

 12.  Implement Arbitration Award on SA pay Scale

 13. Declare placing as AAO on passing of SAS exam as direct recruitment and extend benefits of MACP to Assistant Audit/Accounts Officers.

  14. Designate Supervisor as AAO & Earmark 20% of AAO post for seniority cum fitness              promotion

15.  Remove differential treatment on pay fixation on promotion vis-à-vis direct recruitees in   all cadres

16. Stop downsizing of P&T Audit Offices; conduct audit of private service providers as     per TRAI regulations.

17.    Re-imburse hotel charges to Railway Audit personnel wherever Railway accommodation is not allotted while on tour.

18.    Restore unilateral transfer policy.

19.    Restore metal Pass facility to AAOs in Railway Audit
