SEND LEGAL FUND TO KERALA ASSOCIATION
Dear Comrades,
In a most shocking action, the audit bureaucracy has exposed its ugliest face by ordering the dismissal of Com K.A. Manuel, General Secretary, Audit Category II Association, O/o PAG (Audit), Kerala for participating and leading peaceful trade union actions like demonstrations, dharna etc. The order communicating dismissal from service was served on Com Manuel on 5th March 2009 forenoon.
The National Executive Committee in its meeting held 0n 24-25 February 2009 held at Thiruvananthapuram through a resolution demanded restoration of full TU rights and vacation of victimisations and chargesheets for participating in the legitimate trade union activities.
This action of dismissal of leader of the movement has to be condemned and resisted in unequivocal terms.
1. Every Unit is called upon to hold massive lunch hour demonstration immediately.
2. Week Long Demonstration shall be held for 15-20 minute on every day during 16-20 March 2009. All the members may wear Black bands during the week.
3. Secretary General and two other comrades shall commence indefinite fast in front of CAG's office from 23rd March 2009, in the absence of any positive response from CAG on the letter written to CAG (Copy enclosed)
All members of NE including Special Invitees are to reach HQrs by 22nd March 2009 without fail.
4. Unit leadership shall commence fast from 25th March 2009 in all offices, creating a situation in each office.
Each unit leadership may start massive campaign and mobilisation for the programmes so as to ensure total participation of the members in all the programmes.
It may be brought to the notice of the membership that the chargesheets and victimisations including the dismissal of Com KA Manuel is resorted to by the administration to suppress our movement against privatisation and outsourcing of functions (The Kerala agitation began against outsourcing of pension work).
In addition, every Unit should remit Rs 10/ per member towards Legal Fund to Audit & Accounts Association, Kerala (This should be paid from the funds of the Association, not through separate collections). This shall be remitted immediately on receipt of this Circular.

Sir,
I am deeply shocked to learn that Shri KA Manuel, Assistant Audit Officer who is General Secretary, Audit Association Category II, O/o Pr Accountant General (Audit), Kerala has been awarded with a penalty of dismissal from service for having participated in peaceful protest programmes like demonstrations etc.
Now there is not an iota of doubt that the so called disciplinary proceedings and actions of the Accountants General, Kerala administrations are not normal proceedings to tackle indiscipline; these are naked acts of victimisation which my organisation is not prepared to accept. We have seen that in the other cases also at the appellate stage what has been done is to uphold the finding of guilt and not the vacation of the charges.
I therefore request you that you may kindly intervene and through a suo moto review quash all the penalties which have been awarded to the concerned employees of the Accountants General, Kerala. In cases where the proceedings are still on you may kindly halt these proceedings and quash the motivated and biased charges on which the proceedings are continuing.
In this connection I am submitting a copy of the Resolution adopted in the meeting of National Executive Committee held on 24-25 February 2009 at Thiruvananthapuram for perusal and consideration.
I conclude by stating that I along with my colleagues expect some favourable response from you with a fortnight or so. In the even of no response is given to us we may have to resort to appropriate Trade Union actions. However I am of the view that the situation will not be precipitated as I believe that you would surely respond positively in favour of affected employees.
