CONVENTION CALLS FOR REORGANISING LOCAL JACS
            The National Convention of Accounts & Audit Employees and Officers held at Hyderabad on 10th January 2016 was attended by nearly 200 delegates representing All India Audit & Accounts Association, All India Audit & Accounts Officers Association, All India Civil Accounts Employees Association, All India Civil Accounts Employees Association Category II, All India Postal Accounts Employees Association, All India Pay & Accounts Officers Association (Civil), All India P&T Accounts & Finance Officers Association and ,  All India Federation of Divisional Accounts Officers and Divisional Accountants Associations.

            The Convention was inaugurated by Com Venugopal, former General Secretary, All India Insurance Employees Association.
            In all 20 speakers participated in the discussion on the declaration presented by Com V Bhattacharjee, Convenor.
            The Convention called upon the constituent organisations and its field formations to ensure formation of JAC in all stations so as to carry out the calls of the Apex JAC effectively and purposefully.
            The Convention called upon all the audit and accounts employees and officers to observe day long dharna at a centralised place in every station, under the banner of JAC, on 11th February 2016. This will be followed by Signature campaign on the charter of demands. The
Convention also decided to organise Dharna at New Delhi in June-July 2016.
            Copy of the declaration adopted by the Convention and the JAC circular are attached.

AMENDMENT TO RECRUITEMENT RULES
            The Recruitment Rules for Auditor/Accountant, Senior Auditor/Accountant were expected to be notified in the month of February. But the new condition introduced by the DOPT that the draft notification has to be first placed in the public domain for comments before it being processed has delayed it.
            It means that after the statutory one month, the whole process for approval by DOPT and Law Ministry will have to be repeated, causing delay.
            This also would result delay in the promotion of DEO as Auditor/Accountant till the revised recruitment rule for Auditor/Accountant is notified in the Gazette. It may take another 6 -8 months for the whole process to be over.
            In the mean time, CAG administration has issued circular on training and promotion of DEO as Console operator – DEO Gr II with GP 2800 – for those who have put 5 years of service.
            This has caused doubts in the minds of DEOs that they will not have chance to become Auditor/Accountant.
            This issue was raised with administration – especially in the background of the RR for Auditor/Accountant getting delayed. We have requested that those who get promoted as Console Operator may also be given opportunity to become Auditor/Accountant as and when the revised Recruitment Rules for Auditor/Accountant are notified, maintaining their original seniority in DEO cadre. This has been positively responded by the administration. We will have to be vigilant to ensure that the same is implemented.

            The extended meeting of the National Executive Committee on 9th January 2016 decided that leaders should visit the units to prepare the units for the forthcoming indefinite strike. The following tour programme is finalised within the shirt time available.

DECISIONS OF NATIONAL CONVENTION
As decided, the National Convention of the Accounts and Audit employees and officers’ organizations was held in Hyderabad on 10thJanuary 2016. Nearly 200( two Hundred) delegates representing All India Audit & Accounts Association, All India Civil Accounts Employees Association, All India Postal Accounts Employees Association,  All India Audit and Accounts Officers Association, All India Association of Pay & Accounts Officers (Civil), All India Civil Accounts Employees Association, Category-II, All India Federation of Divisional Accounts Officers and Divisional Accountants Associations and All India P&T Accounts & Finance Officers Association from different parts of the country participated in the convention.

Com. M.S. Raja, Chairman introduced the background and necessity of the convention to the participants. Then the convention had extended its condolences to the departed leaders like Comrade S. K. Vyas, Comrade A. B. Bardhan and Martyrs of terrorist attack in Air Force base, Phatankot and also others by observing two minutes silence.
Com. K. Venugopal, ex-Secretary General, All India Insurance Employees Association inaugurated the Convention. In his inaugural speech he explained various aspects of the retrograde recommendations of 7th pay Commission. Com. Venugopal also explained the conspiracy and dangers involved in the anti-employee (new) National Pension Scheme (NPS) and the disastrous affect of pension reforms and thereby the need to build up a strong movement by the Central Government employees unitedly to resist the onslaughts. 
After the inauguration, Com. A. P. Shastri, former president of the All India Postal Employees Accounts Employees Association released a Calendar commemorating Com. S. K. Vyas, the legendary leader of Audit & Accounts and Central Government Employees and Workers.
There after the Reception Committee for the Convention had offered felicitation to Com. V. Bhattacharjee, Convener for his induction as one of the members of the staff side, National Council JCM for the first time.
On behalf of the apex level Joint Action Committee, the Draft Declaration was placed by Com.V. Bhattacharjee, Convener.

All the speakers on the draft declaration were unanimous on the need of intensified struggle under the banner of JAC for achieving the demands of Audit and Accounts cadres.
The house unanimously adopted the declaration with minor amendments and took following decisions:-
1.      Formation/Revival of Local JACs’-
All stations/Branches/Units/ Circles shall form/ revive local JACs in war footings and inform JAC headquarters. The task would be completed within 10th February 2016.
2.      Daylong Dharna - 
 The local JACs shall organize day long, centralized Dharna on 11th February 2016 under the banner of JAC.
3.      Signature  campaign
Signature campaign shall be organized and initiated immediately.  All Units/Circles/ Branches shall deposit the Signatures to their respective Central Headquarters within 28th February 2016.  Draft of the representation on which the signatures are to be collected shall be circulated by apex JAC. 
4.      Massive  Dharna at Delhi
A massive Dharna shall be organized in Delhi by the apex JAC. The Dharna would be in the month of June/July, the exact date shall be decided by the apex JAC.
While speaking all speakers had expressed their tremendous happiness for the arrangements made by the local JAC, Hyderabad and immensely praised the leadership of the local JAC of Hyderabad for providing best food, accommodation and venue for the convention.
The Convention was declared over after offering of vote of thanks by Comrade D. Narasimha Murthy, Chairman, JAC Hyderabad unit.

NATIONAL CONVENTION ON THE DEMANDS OF GRANT OF APPROPRIATE PAY SCALES TO EMPLOYEES AND OFFICERS OF ACCOUNTS AND AUDIT

DECLARATION

The representatives of  All India Audit & Accounts Association, All India Civil Accounts Employees Association, All India Postal Accounts Employees Association,  All India Audit and Accounts Officers Association , All India Association of Pay & Accounts Officers (Civil), All India Civil Accounts Employees Association, Category-II, All India Federation of Divisional Accounts Officers and Divisional Accountants Associations met in the  National Convention on 10th January 2016, Conference Hall, 4th Floor, Nirman Bhawan, CPWD, Koti, Hyderabad.
The Convention, in conformity with the observations given by the National Joint Council of Action of the Central Government Employees, totally rejects the anti-employee recommendations of the 7th CPC. The mutilation of Dr. Aykroyd formula in computation of minimum wages based on the 12-monthly average (ending on 1.7.2015) prices of essential commodities supplied by Labour Bureau at Shimla was a total jugglery on the part of 7thCPC. 
The convention considers that, reduction in the wages of women employee who avail CCL, forcing the employees to go on voluntary retirement on completion of 20 years of service in the name of ‘inefficiency’, earmarking ‘very good’ for MACP, withdrawal of all types of short term advances like festival/cycle/ LTC etc, refusal to recommend for scrapping of new Pension scheme, refusal to propose for dispensing with the outsourcing/casualisation/ contractorisation by regularizing the  employees engaged through such methods for regular government functions  are the most retrograde and  the anti-employee recommendations of the 7CPC.
The meeting noted that on the issue of formation of Apex Level Grievance redressal mechanism to the Group B Gazetted Officers and Promotee Group A Officers, even after 67 years of independence, settlement has not taken place mainly because of intransigent and adamant stand of the Ministry of Finance, Government of India.  The meeting noted that on all other demands also there is a dilly dallying attitude on the part of authorities resulting in non-settlement.
The Convention congratulates the Central Government employees for observing 27th November 2015 as BLACK DAY by wearing black badges and holding (lunch hour) demonstration at the work place and organizing lunch hour demonstration on 30th December 2015 responding to the call of NJCA, which was duly endorsed by the Confederation.
The Convention endorses the 26 Point Charter of Demands on issues related to the recommendations of the 7th CPC submitted to the Cabinet Secretary on 10th December 2015 by the Staff Side, National Council, JCM and on behalf of the NJCA and also by the CCGGOO to the Government to discuss and settle the demands immediately.
The Convention also endorses the decisions taken by NJCA on organizational actions including the decision of massive Dharna on 19th, 20th and 21st January 2016 and Indefinite Strike in the 1st Week of March 2016 with an appeal to the entirety of the Accounts and Audit Employees and Officers of the country  to  prepare  and  participate  in  all  preparatory programmes and the Strike action under the
guidance of the local Co-ordination Committees and JCAs.
The Convention takes the opportunity to congratulate all those employees and officers of Indian Audit and Accounts Department and other organised Accounts Cadre who responded the call of Apex JAC i.e. observance of demands day on 15th December 2015 and submission of the demands of the Accounts and Audit Employees and Officers in the form of Resolution to local Head of Offices for onward transmission to higher authorities.
The Convention totally agrees with the following proposals for pay structure for Audit & Accounts Cadres submitted by the apex level JAC to secretary, Department of Expenditure ON 11TH December 2015 seeking mitigation of the injustice done to the accounts and audit cadres by the 7th CPC.
1.   Accounts/Audit Assistant:
Re-designation of LDC as Accounts/Audit Assistants and grant of replacement scale of PB-1 Grade Pay Rs.2400     --  i.e. level 4 pay scale of Table 5.Pay Matrix.
2.   Accountant/ Auditor:
Correction of error done in implementing 6CPC recommendations by the Government and Grant of replacement pay scale of PB 2 GP 4200 --  i.e. level 6 pay scale of Table 5 in Pay Matrix.
3.   Senior Accountant /Auditor (SA)/DA:
Streamlining the contradictory views and recommendations of 7th CPC and grant of replacement pay scale of PB 2 GP 4600 --  i.e. level 7 pay scale of Table 5.Pay Matrix to the Senior Accountant/ Auditor/Accounts Assistants (in Railways).
4.   Assistant Accounts Officer/ Assistant Audit Officer/DAO II:
      Acceptance of Para No. 11.12.140 of the recommendations of 7th CPC and grant of replacement pay of GP 5400(PB-2) to AAOs on completion of four years’ service --  i.e. Pay level 9, in the pay matrix.
5.   Accounts/Audit/Senior Accounts/Audit Officer/DAO I/Sr. DAO:
              Grant of following pay scales to the Cadres indicated:
              Audit/Accounts Officer/DAO Gr. I GP 6600 PB-3 -- i.e.level-11 pay scale of Table 5.Pay Matrix
              Sr. Audit/Accounts Officer/Sr. DAO (15%) GP 7600 PB 3  -- i.e. level-12 pay scale of Table 5.Pay    Matrix.
6.   Qualification Pay
Granting qualification Pay to all Organized Accounts and IA&AD uniformly in terms of the recommendations of 7 CPC in Para’s 8.9.43, 44 and 45 respectively.
7.   Secretarial Staff
Pay scale of secretarial staff working in Account and Audit Organizations may be granted at par with Secretarial staff working in the Ministry.
8.   Cadre review
Since no cadre review of Accounts and Audit departments had been done after 1987, the cadre review should immediately be initiated as per the recommendations of 7thCPC.
The Convention further resolves to:
·     Reorganize and reactivate the local committees of the Joint Action Committee at every station within 10th February 2016.
·     Organize following sustained agitational programmes.
1.     Daylong Dharna at all stations by the local JACs on 11th February 2016 
2.     Signature  campaign – all units/circles/ branches shall deposit the Signatures to their respective Central Headquarters with in 28th February 2016

3.     Massive  Dharna at Delhi

‘COMRADE SK VYAS MEMORIAL LECTURE’
 ON 13 FEBRUARY – EVERY YEAR

            It is going to be one year on 13th February – we are yet to get adjusted to the reality that Com SK Vyas is not amidst us.

            The role of Com Vyas in the audit movement, in the movement of central government employees shall ever be remembered. No history of either audit movement and for that matter of central government employees’ movement can be written without SK Vyas. His role, involvement, contributions and above all the sacrifices are beyond words, unparalleled.

            There will not be a replacement for Com SK Vyas – and there cannot be also. He is a glittering star that will guide us in the days to come.

            The National Executive Committee felt that the remembrance of Vyasji cannot and should not be quite ritualistic. Vyasji was a voracious reader, he read anything that came on his way. From trash to classics he read. Vyasji used to advise not to ignore anything as trash or something that is too hard to understand. You have something to learn from everything and anything will be understood when you want to, that is what Vyasji used to tell us.

            Naturally, the best tribute to Vyasji would be by gaining some knowledge, some more information on a subject, using it for growth of the movement and advancement of the society.

            The National Executive Committee therefore calls upon all the Units to organise, here onwards, COMRADE SK VYAS MEMORIAL LECTURE on 12th February in every station, this year and on 13th February every year – on a given subject. The speaker should be somebody who can present the subject in its entirety. A leading, learned figure in the station may be chosen as a speaker.


The subject for this year is:

Demand for Minimum wage and Living Wage – in the context of economic liberalisation.

The National Executive Committee further decided to bring out a souvenir in memory of Com SK Vyas – every unit is requested to contribute their mite towards souvenir. The idea is to release the souvenir in a function on 15th April – Association Day at New Delhi. The details shall be communicated later, separately to each unit.

All the Units are requested to organise “Com SK Vyas Memorial Lecture” with maximum participation and a detailed report may be sent to HQr.

It shall be highly appreciated if every unit e-mail the transcript of the lecture to HQr which can be printed in the souvenir which shall be useful to all.

NE CALLS FOR
* INTENSIFIED CAMPAIGN ON RETROGRADE RECOMMENDATIONS OF 7 CPC
                ** MASSIVE PARTICIPATION IN THE 3 DAY DHARNA UNDER NJCA BANNER
                *** PREPARATION FOR INDEFINITE STRIKE

            The National Executive Committee held on 9th January 2016 at Hyderabad endorsed the views expressed by the Confederation of Central Government Employees and Workers and also by the NJCA on the recommendations of the 7 CPC and called upon the personnel of IA&AD to join the struggles for improvements in the recommendations.

            The NE re-iterated the decision of the NJCA, endorsed by the Confederation, to demand to recalculation of the minimum wage determined by the 7 CPC, terming it arithmetically wrong and hence a fraud on the employees. The minimum wage and the fitment formula have to undergo changes as per the Dr Aykroyd formula, based on the current prices of essential commodities as prevalent in the market on 1.1.2016. The meeting adopted the 26 point charter of demands and decided to mobilise the membership and the entirety of working personnel in Indian Audit & Accounts Department in the struggle for ensuring the acceptance of the 26 point charter of demands.

            The NE meeting called up on the all the Units and the members to join enmasse in the 3 –day dharna on 19-20-21 January 2016, call for which has been given by the NJCA.

            The NJCA has decided to organise the indefinite strike in the first week of March 2016 if the government does not negotiate and settle the demands raised by the Staff Side, JCM vide its letter dated 10th December 2015 within two months. The NJCA would meet on 8thFebruary 2016 to decide the date of strike, if no negotiated settlement is arrived at by then.

            The NE meeting noted that though it is nearly two months since the submission of  the report by the 7 CPC the Government is yet to form the Empowered Committee - except a statement regarding its intention to do so no concrete measure has been initiated.
            (The government has now announced that the cabinet approval has been given for the appointment of empowered committee, though the formal notification on its constitution has not been done).

            It looks as if the government intends to dilly-dally and delay and thus deny any improvement in the recommendations of the 7 CPC which are nothing but a fraud on the employees.

            There is a need to intensify the campaign amongst the employees and officers, raising a banner of revolt on the recommendations of the 7 CPC. The anger prevalent amongst the employees should be channelised through organisational mobilisation so that more and more employees and officers join the protest actions and the indefinite strike.
           
            While focussing on the general recommendations of the 7 CPC on the minimum wage, fitment formula, HRA, Advances, CCL etc, we should also educate the employees and officers of the raw deal given to the IA&AD and Organised Accounts Cadres by the 7 CPC. Our Circulars 26 and 28 (of 2015) may be widely used in this regard. Our Letter to CAG on the recommendations and improvements required may also be used in the campaign.  (Copy enclosed).

            The National Executive Committee authorised the Secretariat to chalk out appropriate mobilisation programmes through visit of office-bearers to various stations. It further decided to co-ordinate with programmes chalked out Confederation.

Sir,

I am to invite your kind attention to the recommendations of the 7 CPC. All India Audit & Accounts Association is of the considered view that the 7 CPC has let down the Central Government employees in general and Audit & Accounts cadres especially.

This Association, with a deep sense of gratitude, acknowledges the honest and sincere efforts made by the Hon’ble C & A. G of India in projecting the just demands of various cadres of IA&AD, recommending up-gradation of the scales of staff in IA & AD in his memorandum to 7th CPC.  

But the 7th CPC without analysing - critically and rationally - any aspect of the memoranda submitted by the Hon’ble CAG of India as well as the Staff Side has summarily rejected all the submissions made before it by the CAG of India (and also by the Staff Side) resulting in great disregard to the august office. This outright rejection of the demands put up by the CAG of India and the staff side has given a stunning blow to the morale of the personnel of IA&AD.

 We are sure that the Hon’ble CAG of India will make unfailing efforts in making Government understand the indignation and heart burn of the staff of IA & AD. 

It is further submitted that the C&AG of India to use his good offices to make the government understand the negation of factual positions on the part of 7 CPC with regard to grant of parity in pay scales to Senior Auditor/Accountant vis-à-vis Assistant of CSS.

We here-by submit our comments & views on the departmental issues vis-à-vis the report of the 7 CPC.
1. a) We request that the government may kindly be moved on the specific comment of the 7  CPC that the Government had never granted parity in pay scale to SA with
Assistants of CSS. This statement of 6 CPC remained to be corrected and has been repeated by 7 CPC.

This statement is factually wrong and hence totally unacceptable. In 1983, the        Government of India had vide letter from SC Mahalik, Jt. Secretary, Min. of Finance, Deptt of Expr. addressed to Shri AK Mitra, Director (Staff), O/o C&AG of India DO No 110141/1/78-EG-I, dated September 21, 1983 accepted the demand for grant of parity – to 80% of Auditor cadre. (Copy enclosed).

The 4th CPC extended the pay higher pay scale to Accountants also - OM No F.5 (32)-E.III/86-Pt.II, Ministry of Finance, Deptt of Expenditure date 12th June 1987. (Copy enclosed).

The laborious effort of the Administrative Staff College, Hyderabad in conducting work study on the then Auditor’s cadre has been given a burial by the successive pay commissions. This point may kindly be driven home.

b) The 7 CPC has rejected the demand for GP 4200, PB2 to Auditor/Accountant on the untenable ground that they are not subjected to personal interview at the time of recruitment. The fact that they have to qualify a departmental confirmatory examination for confirmation, failing which facing reversion as LDC, has been overlooked.

2) The recommendation of 6 CPC with regard to grant of GP 5400 in PB3 to all Gazetted officers remained to be implemented in the case of AAO of IA&AD and Organised Accounts.

In Chapter 11.62, vide para 18 on IA&AD the 7 CPC recommends “replacement levels for AAO, AO and SAO”. But vide Para 11.12.140 – Ministry of Defence, Organised Accounts - the report states “The Commission is therefore of the view that there is no justification for excluding officers in the organised accounting departments who are at GP 4800 from this dispensation. It therefore recommends that all officers in organised accounts cadres (in the Indian Audit and Accounts Department, Defence Accounts Department, Indian Civil Accounts Organisation, Railways, Post and
Telecommunications) who are in GP 4800 should be upgraded, on completion of four years’ service to GP 5400 (PB-2), viz., Pay level 9, in the pay matrix”.

     This may kindly be ensured that this recommendation is implemented in IA&AD without fail.

(The slight of IA&AD and thus CAG of India may please be strongly objected to).

3) The 7 CPC has also not accepted the demand for grant of higher pay scale to AOs and SAOs. The rejection of the demand by the 7 CPC is quite arbitrary and lacks logic –
rather, the 7 CPC has failed to advance any logic for refusing higher pay of GP 6600 and 7600 in PB3 to AOs and SAOs. The argument that Senior Audit/Accounts Officer is a feeder cadre for Gr A is arising from wrong understanding. The SAO, on promotion, is posted as Dy Accountant General/Dy Director on promotion, not at the level of Direct Recruitee IA&AS.

4) The same treatment has been meted out to Divisional Accountants and Divisional Accounts officers. The submissions made by the CAG of India as well as by the Staff Side has been totally ignored and rejected.

5) Apart from the rejection of the demands on pay scales that the Department and the staff side put forward, the 7 CPC has also recommended for the discontinuance of all advances – including advances for Travel, Tour etc and advances for medical treatment. The discontinuance of advances for travel and tour will have an adverse impact on the personnel of IA &AD more than any personnel of any other department.  We therefore submit that the Department may insist on continuance of all existing advances.

6) Also, the recommendation for production of bill or voucher for re-imbursement of accommodation charges and daily travelling expenses is to be waived as it was done after the implementation of 6 CPC recommendations. Self certification should be permitted disregarding the level (in the pay matrix) in which the person is placed.

7) Qualification Pay (Chapter 8.9)
On grant of additional pay/increment on passing of SAS examination also, IA&AD has been left out while there is a recommendation for Railway Accounts Staff.
The relevant portion of the report of 7 CPC is reproduced below:

“8.9.43  It is granted to Accounts staff of Indian Railways for qualifying certain examinations.

Clerks Gr.II (Accounts Clerks)/Typists on passing App-II Examination
Rs. 180 pm
Sr. Accounts Assistant/Accounts Assistant/Stock Verifier/
Typist/Stenographer on passing App-III Examination
First Year                  Rs 240
Second Year             Rs 420

8.9.44 Demands have been received to increase the allowance to four times its present value.

Analysis and Recommendations

8.9.45 Since the allowance is not indexed to DA, it is recommended to raise it by a factor of2.25. The amount will further rise by 25 percent each time DA crosses 50
percent. The nomenclature should be changed to Railway Accounts Examination Allowance.”

It may kindly be ensured that IA&AD personnel is also assured of the additional pay/increment as is recommended for Railway Accounts Staff on passing of SAS examination.

The 7 CPC is totally silent on the Qualification Pay granted to Auditor/Accountant on passing of Departmental Confirmatory examination. Grant of Qualification pay for Auditor/Accountant on passing of Departmental Confirmatory examination may also be increased on the same analogy of using the multiplication factor of 2.25 with further rise by 25% each time the DA crosses 50%.

8) On Internet Allowance, Mobile Phone Allowance & News Paper Allowance, it has been recommended by 7 CPC - “The ministries should continue dealing with these allowances on their own, subject to the ceilings notified by the Ministry of Finance from time to time. The present ceilings should, however, be raised by 25 percent and the entire amount should be paid, lump sum, to the eligible employees without the need for production of vouchers.” (Para 8.17.61). This may please be made applicable for the personnel of IA&AD also.   

It is requested that the CAG of India may take a firm stand in the Empowered Committee that may be formed to finalise the recommendations so that the ignominy faced by IA&AD and its personnel from top to bottom is rectified and higher pay scale is granted to personnel of IA&AD (and also of Organised Accounts).

We shall be submitting our comments and proposals on the general recommendations of the 7 CPC on minimum wage etc separately.

This is in continuation to this Association’s letter AIA/B-1/74/2015 dated 3rd December 2015 on the recommendations of the 7 CPC.        

Issues specific to IA&AD has been covered in our earlier letter mentioned above. Here, we present our views and objections to the recommendations of the 7 CPC on issues such as minimum pay, fitment formula, increment, MACPS, allowances and other general issues, briefly.

1. Minimum Wage

We strongly disapprove the method of calculation of minimum wage.
1. The rates of commodities are taken from a dubious source i.e. Indian Labour Institute Shimla. Prices of commodities arrived at is 9217.99
      The website of the Agricultural Ministry gives the retail prices of various places. Even according to it the prices of commodities will come to Rs. 11,342 as on 1.11.2015.
     Secondly, the Commission has taken the average of 12 months. This is not acceptable.   It should be as on 1.1.2016 or atleast as on 1.11.2015.
    For Misc. 20% is correctly taken.  Whereas for Educational and Recreation the S.C. judgement is 25%, the CPC has reduced it to 15%. Not acceptable.
    Housing must be 7.5%. This has been taken as a lumpsum of Rs. 524 i.e. 3% similar to the exercise done by the 6th CPC.  Not acceptable.  It has to be 7.5% .
   The weightage for skilled labour has been correctly taken at 25%.

i)  If Aykroyd formula is applied correctly as agreed upon in the 15 ILC (1957) added with the 25% weightage as directed by the SC in 1992, the minimum wage would work out to Rs 20,760/- even on the fraudulent figure of 9218/-
     Adding 3% against future DA, it would become) Rs 20760+623 = Rs 21,383/-
ii) If the agricultural ministry figures are taken for computation, then 9218 would be replaced by Rs 11,342/ and the minimum wage would be Rs 25,549/- as on 1.11.2016.
                 The minimum pay needs to be corrected as above. 
    
2. Fitment Formula
2.57 is arrived at on the basis of an arbitrary, unscientific and hence irrational calculation of minimum wage at Rs 18,000/- . Change in minimum pay and thus a change in the fitment formula is a must.
                 The fitment formula has to be corrected based on the proposal given at 1.
                  i.e. 3.05 according to 1 (i)
and 3.65 according to 1 (ii) which is the most logical and correct one doing justice.

3. Ratio between Minimum wage and highest wage
            Highest salary: 18000:225000 i.e. 1:12.5
            If we take pay of Cabinet Secy the ratio is 1:14.  The ratio is more than even what the    6th CPC recommended.
            We demand a ratio of 1: 8

4. Multiplication Factor
            The pay scales have been constructed by applying different multiplication factor. 
While it is 2.57 for PB 1, 2.62 for PB2, 2.67 for PB 3, 2.72 for PB4 and 2.81 for Secretary level officers.
The different rates are meant to maintain the existing disparity introduced by the 6th CPC. 
The common multiplication factor should be applied – after the correcting the minimum wage calculation.

5. Increment
            The increment granted is less than 3% as per the matrix given.
For e.g., in the matrix level 1, the pay becomes 18500 after one increment instead of      18,540. This could be seen at many stages.
3% increment should be ensured to all at every level, stage.

6. HRA
HRA as per centage of pay has been reduced to 24%, 16% and 12% from the existing 30% , 20% & 15% - the CPC  has irrationally applied a multiplication factor of 0.8 at every stage which is not acceptable. The existing rates should be retained.

7. Increment on Promotion
Only one increment recommended, it should be raised to two increments (on promotion).

8. Group Insurance
            Huge hike is proposed under group insurance scheme. This is quite disproportionate.
It should be reduced to Rs 350, Rs. 750 & Rs. 1500 with insurance cover of Rs 3,50,000, Rs. 7,00,000 and Rs. 15,00,000

9. MACPS
1. MACPS should be unambiguously on the basis of cadre hierarchy available in the respective Departments.
2. The condition of “very good’ the annual performance appraisal to be eligible for getting benefit of MACPS is not acceptable.  The eligibility criteria should be only “average” in the APR.

10. Efficiency Bar
Introduction of “Efficiency Bar” which was discarded by 5 CPC and linking future increments to earning of Very Good remark in the APR is totally reprehensible and hence not acceptable. This should not be accepted. The present status should continue.
11. Advances
All kinds of interest free advances are recommended to be abolished. This is a retrograde recommendation. All existing interest free advances such as Travel & tour advance, festival advance, cycle advance, medical advance, house building advance, natural calamity advance etc. should continue.

12. Allowances
Allowances like for Small family Allowance, Cash Handling allowance etc should continue.

GOVT FILED ITS AFFIDAVIT TODAY MORNING. DURING THE PRESENTATION THE GOVERNMENT ADVOCATE  STATED THAT THIS BENCH HAS ALREADY DISMISSED A SIMILAR PETITION IN NOVEMBER 2015. JUDGES (i.e. THE BENCH) STATED THAT THIS ARGUMENT CAN BE MADE ON 26TH MARCH 2016 WHEN THE CASE WOULD BE HEARD FOR FINAL DISPOSAL.

GOVT DID NOT FILE THE AFFIDAVIT. THE BENCH GAVE TWO WEEK'S TIME FOR THE GOVT  TO FILE THE AFFIDAVIT. THE CASE WOULD BE HEARD FOR FINAL DISPOSAL ON 21ST MARCH 2016, THE JUDGES (i.e. THE BENCH) SAID.

AS OUR ADVOCATE WOULD  BE OUT OF DELHI DURING THE WEEK OF 21-26 MARCH 2016, SHE SOUGHT CHANGE OF DATES. 

THE NEXT DATE FOR HEARING BOTH THE CASES WOULD BE, HENCE, 28TH MARCH 2016. 


FINAL DISPOSAL DOES NOT MEAN IT WOULD BE HEARD AND DECIDED ON THAT DAY ITSELF. THE GOVT WOULD TRY TO DELAY IT FURTHER - THE SENIOR ADVOCATE COULD ABSTAIN, THIS IS THE NORMAL METHOD ADOPTED BY GOVT. NOTHING CAN BE SAID FOR SURE REGARDING GOVERNMENTS DELAYING TACTICS.
