PLUNGE INTO MOBILISATION FOR SUCCESSFUL INDEFINITE STRIKE

As per the decision of the Confederation, endorsed by Special Conference of our Association, the Central Government employees would go on indefinite strike from 20th January 2009 on the 20 point charter of demands.
The leaders of Confederation would serve strike notice on 2nd January 09 to Cabinet Secretary after massive demonstration at Parliament House. We will serve strike notice to CAG on 2nd January 2009 after the serving of the notice by Confederation.
Tour programme of leaders have already been circulated vide Circular No 36-2008. Units shall make out all out effort to educate and prepare the employees for the massive indefinite strike from 20th January 2009.
Units may ensure maximum participation by our leaders and activists in the Convention that is being held under local COC banner from 6th Jan to 9th Jan 2009.
The strike notice that we would be serving will have two sections, one the charter of demands adopted by the Confederation and two, the Departmental Charter of Demands adopted by the Special Conference.
The higher pay scale can be achieved and the disadvantages in the ACP, increment date, TA/DA rates & conditionalities can be removed/improved only through best mobilisation of membership and successful strike.
Similarly, unless and until the government is forced through united action to lift ban on recruitment our fight for filling up of posts cannot be achieved.

The units may hold Mass Meetings on 6th January 2008 and endorse the strike notice served by Confederation and All India Association and hand over to (P)AG/PDA/Director/DD with a covering letter. A draft resolution is also given.
JAC TO MEET AT CHENNAI ON 11TH JAN 09
Apex JAC met on 13th December 2008 and adopted a charter of demands. It decided to circulate charter of demands to all Constituents and local JACs to elicit their views. The Apex JAC would meet at Chennai on 11th Jan 2009 to finalise the charter of demands and decide course of action.
All Units may take lead in convening the local JAC and send their proposal if any before 11th Jan 2009.

We submit herewith a copy of the notice for indefinite strike served on the Cabinet Secretary by the Confederation of Central Government employees and workers to which the All India Audit & Accounts Association is affiliated. As per the decision of the National Executive meeting of the Confederation held on 13th December, 2008, which has been endorsed by our Federation, we hereby give notice to you that the employees who are members of this Federation will embark upon a strike action commencing from 20th January, 2009 for settlement of the enclosed common demands of the Central Government employees and for settlement of the demands in Section II which are specific to the employees of Indian Audit & Accounts Department. You are specifically requested to take necessary steps to bring about settlement of the demands which are department specific.

Section 1
Part I 6th CPC related issues
1. Grant Rs 10000 as minimum wage as per 15 ILC Norms.
2. Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise of 40% in emoluments and raise grade pay to 50% of the maximum of the pre-revised scales in respect of PB 1,2 & 3 as has been done in the case of PB 4.
3. No abolition of Gr.D. Posts and functions. Lift ban on recruitment, fill up all vacant posts and scrap screening Committee.
4. Grant 10% of pay+ Grade pay as minimum benefit on promotion or financial up gradation.
5. Fix the date of effect of all allowances as 1.1.2006.
6. No performance related pay or bonus scheme
7. Revise the Transport and daily allowances as demanded by the staff side JCM National Council.
8. Remove the condition of 6 months for applying the uniform date of 1st July as increment dates.
9. ACP to be on hierarchical system obtaining in each department.
10. Retain and improve CGHS and make insurance scheme optional
11. Implement flexitime working hours for women/disabled employees as recommended by the 6 CPC and remove clause (iv) of OM No.13019/2/2008-Estt.(L) dated 18th Nov. 2008 on Child Care Leave.
12. Direct all the Departmental Heads to settle 6th CPC related department specific demands/problems within a stipulated time.
13. Grant civil servant status and Pension to 'Gramin Dak-Sevaks.'
14. No reduction in the commutation value and restoration of full pension after 12 years.
15. Compute the pension entitlement on the basis of notional pay as on 1.1.1996
Part II - Demands pending settlement for long in the National Council JCM
1. No outsourcing or contractorisation of Govt. functions.
2. Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.
3. Implement the Board of Arbitration Awards.
4. Remove the arbitrary 5% ceiling and 3 years condition on compassionate appointment and withdraw court cases and absorb all waitlisted RRR candidates.
5. Implement the revision of bonus ceiling @ 3500/- in the case of all personnel employed by the Government including casual/contingent and daily rated workers and Grameen Dak Sewaks. Replace adhoc bonus with the PLB and remove the 60 days ceiling.
Section II
1. a) Vacate victimization of Association activists.
b) Allow democratic functioning of Association without interference from administration
2. Strengthen Audit & Accounts to Safeguard People's Rights
a) Stop down sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap curtailment/shedding of Audit functions in the name of Audit Plan.
b) Ensure continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms.
c) Ensure effective Panchayati Raj Audit & Accounts by sanctioning more posts.
3. Redesignate LDC as Audit/Accounts Assistant, grant PB1 Grade Pay 2800 (4500-7000 pre-revised) and grant following pay scales to other cadres, maintaining vertical relativity.
Auditor/Accountant/Steno Gr II : PB2, GP 4200
SA/Steno Gr I : PB2, GP 4600
SO/AAO/Private Secretary : PB2, GP 4800
& PB3 GP 5400 on completion of 4 years
AO : PB3, GP 6600
SAO : PB3, GP 7600
4. Fill up all vacant posts and sanction adequate post as per the agreement of 16.10.1992.
5. a) Amend Company Law and DPC Act for Audit of Public Sector Undertakings & Corporations even after reduction of Government share to below 50%.
b) Amend Company Law to ensure the Audit by IA&AD of all Public Limited Companies listed with Securities and Exchange Board of India (SEBI)
c) Enact necessary law to bring audit of all public Financial Institutions by IA&AD.
6. Permit graduate Gr.D employees to appear SOG Examination as before.
7. Step up of pay of senior promotees who exhausted ACP, in the event of juniors drawing more pay on getting ACP.
8. Grant ACP on hierarchical pattern.
9. Re-designate Supervisor as Section Officer; grant further promotion upto AO/SAO; earmark 20% of AAO (SO) cadre for Supervisors.
10. Grant promotion to employees against the direct recruitment quota.
11. Regularise the ad-hoc Section officers by creating sufficient posts; promote all SOGE passed hands as one time measure; Grant one increment and Grade pay of AAO on passing SOG Exam.
12. Restore unilateral transfer policy.
13. Restoration of provision of Metal Passes to AAO's working in Railway Audit Offices.
14. Remove the economic criteria for Compassionate ground appointment and re-open all past cases.
15. Revise TA/DA rates and permit self certification to claim re-imbursement of food and conveyance charges
16. Grant three increments on passing departmental Confirmatory examination.

Resolution to be adopted by the units on 6th Jan 2009
This mass meeting of members of ………Association,… endorse the strike notices served by Confederation of Central Government Employees and Workers and All India Audit & Accounts Association.
This meeting urges upon the Government of India as well as the CAG of India to initiate dialogue so as to settle the genuine demands failing which the members of this Association would join the indefinite strike commencing from 20th January 2009.

As scheduled, the meeting of the apex level JAC was held on 13th December, 2008 in Delhi. The meeting was attended by Com. M. S. Raja, Chairman (AIA&AA), Com. V.Bhattacharjee, Convener (AICAEA), Com S.K. Vyas, Chairman, Confederation, R.N.Gupta, Secretary General, AIAPAO(C), Com. S. Santoshkumar, Addl. Secretary General, AIPAEA, Com. V. Nageswara Rao, JAC, AP, Com. A. S. Rawat, Chairman, JAC, Delhi, Com. A. K. Mehta, Convener, JAC, Delhi and Com. M. B. Singh, Br. Secy. AICAEA, Delhi Branch.
The meeting was presided over by Com. M.S. Raja, Chairman. On the Basis of the proposals placed at the time of initiating the discussion by Com. V. Bhattacharjee regarding formulation of a fresh Charter of common demands of the Accounts &Audit cadres, all the representatives of the Constituent organisations and local JACs offered their suggestions in favour of adopting a common charter of Demands.
The meeting also reviewed the Status of the pending arbitration award in respect of grant of higher pay scale to Sr.Accountant/Auditor w.e.f 1-1-1986 notionally and actually from a mutually agreed date on the basis of the discussion held on 25th November 2008 between a delegation of Confederation (comprising Com. S. K.Vyas, Chairman, Com. K. K.N.Kutty, Secretary General, Com. V. Bhattacharjee, Secretary, Com. K. Raghabendran, Secretary General, NFPE and Com. P. Rajnayagam, General Secretary, AIPAEA) and the JS(Per) in the Ministry of Finance. It was observed from this discussion that the Government is in its attempt of rejecting all the 16 awards pending. As far as the issue of grant of parity with Central Secretariat w.e.f.1-1-86 notionally has not also been considered by the Government keeping the proposals given in the meetings of recent past by the staff side (JCM) in view. However, Chairman of the Confederation has issued a letter to the Ministry of Finance and DOPT immediately after the meeting of 25th November pointing out the discussions held in the earlier meetings and demanded implementation of the award notionally w.e.f. 1-1-86 and effectively from 1-1-2006.
After threadbare discussion, the meeting adopted the following demands as draft charter of demands-
1. Implement arbitration award by granting higher pay scale notionally w.e.f.1-1-1986 and effectively w.e.f 1-1-2006.
2. upgrade LDCs by re-designating them as Acctts/Audit Assistants and following pay sales to different cadres-
Accounts/Audit Assistant PB-1 with Grade Pay Rs.2800
Accountant/Auditor/ Steno Gr.II PB-2 with Grade Pay Rs.4200
Sr. Accountant/Auditor/ Steno Gr.I PB-2 with Grade Pay Rs.4600
SO/JAO/AAO/PS PB-2 with Grade Pay Rs.4800
PB-3 with Grade Pay Rs.5400
On completion of 4 years.
3. Grant ACP on departmental hierarchy basis.
4. Grant one increment and Grade pay of Rs.4800 from the day of passing JAO/SOG examination.
5. Grant three increments on passing departmental confirmatory examination.
6. Step up pay of Senior Promotees who exhausted ACP in the event of junior drawing more pay and getting ACP in compliance with apex court judgment.
7. Grant recognition to Railway Accounts Staff Association.
The meeting also decided that the charter of Demands shall be circulated to all for sending their view and suggestions.
It has also been decided by the meeting that the apex JAC shall meet at Chennai on 11th January 2009 to finalise the charter of demands and decide about the course of organisational action(s) to be taken in support of the demands. All local JAC representatives are also to attend.
As the National Executive meeting of the Confederation has taken the decision of indefinite strike from 20th January 2009 and asked its affiliates to incorporate departmental demands in addition to the charter of demands adopted by the Confederation for the Strike, the JAC has decided that the constituents of apex JAC shall incorporate first six demands from the above charter of demands in their departmental charter of demands.
