The Bilateral meeting with Shri Shankar Narayan, DAI was held on 23rd August 2013.  Ms Annie G Mathew, DG, Staff, Shri Ranjit Singh, AC (N) and Shri ML Tamrakar, AO/JCM were present from the official side. The Association was represented by, besides the Secretary General, Comrades M Duraipandian, President, Subhash Chandra Pandey, Vice President and Com V. Nageswara Rao, Additional Secretary General. 

 

Gist of the discussion is given below. (Explanatory memorandum submitted by the Association have already been published in the Auditlekha Samanvay of July 2013)

 

AT the outset, we stated that the agenda for discussion is the Charter of Demands, which is always a combination of statement of organisational position on issues and declared goals along with specific demands.

 

   1.  Strengthen Audit & Accounts to Safeguard People's Rights

       Stop down-sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap    Curtailment/shedding of Audit functions in the name of Audit Plan; ensure continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms; ensure effective Panchayati Raj Audit & Accounts by sanctioning adequate posts; revisit restructuring of Audit effected from 1..4. 2012.

 

      A detailed discussion took place on the agenda. DAI explained that the expansion of PRI audit is not possible as the State Govts are unwilling to handover the Audit to CAG.

     It was assured that the staff related problems on account of the restructuring of Audit with effect from 1.4.2012 would be looked into. From our side, we expressed our concern over the drastic reduction in the compliance/transaction audit.

 

       2. a) Amend Company Law and DPC Act for Audit of Public Sector Undertakings      & Corporations even after reduction of Government share to below 50%.

  b) Amend Company Law to ensure the Audit by IA&AD of all Public Limited   Companies listed with Securities and Exchange Board of India (SEBI)

   c) Enact necessary law to bring audit of all public Financial Institutions by IA&AD. 

 

         There was no discussion on the matter. We sought the co-operation of the authorities in involving ourselves in campaigns on these positions as also on issues stated at 1. The energy of the Association is forced to be diverted on fighting victimisation of its leaders and cadres.

 

   3.     Restructure the audit/accounts cadres as per submitted by this Association &:

 

        i) De-merge the erstwhile Record Keeper from MTS and be granted GP of 1900.

      ii) Upgrade the cadre of LDC and re-designate as Audit Assistant with GP of 2400. Existing LDCs may be promoted as Auditor (Accountant) as a onetime measure.

 

                    Grant the following Grades Pay to other cadres

                                Auditor/Accountant –  4200,

                                                             SA –  4600,

                                                          AAO  – 4800 & 5400 (PB2) on completion of 4 years,

                                                                        AO–  6600

                                                            SAO -  7600 

          iii) Ensure equal opportunity in promotion to stenos of the same station.

 

      The Association stated that it would submit a more comprehensive note on restructuring of cadres.

 

      We submitted the position that the record keepers who were Gr C prior to CCS (RP) 2008 are now clubbed with erstwhile Gr D and forced to do such jobs as of watchmen etc. We therefore demanded that the post of RK may be delineated from MTS with GP 1900. We further submitted that the LDC posts may be abolished and upgraded to GP 2400 merging with DEO. We also insisted that there should be no separate cadre of DEO as it would not have promotional prospects.

 

      DAI appreciated the position and said it would be examined.  

 

      The promotional prospects of Stenographers in the field offices were also discussed. DAI stated that the concern expressed is well taken and effort to find a solution would be attempted.

 

  4.   a)  Vacate victimisation of Association activists.

        b) Allow democratic functioning of Association without interference from administration

      We explained the position existing in various offices. DAI assured to examine the issue.

 

      As regards denial of special casual leave, non granting of meetings by Accountants General,  obstructing functioning of the Association etc. it was assured that instructions in this regard would be issued afresh.

 

      The issue of blanket denial of permission for holding demonstration in the office premises was raised by us and requested that the specific Para in the Circular issued in February 2012 may be deleted.

 

  5.               Fill Up all vacant posts through local recruitment.

 

      There was a detailed discussion on the subject. The need for knowledge of local language by our personnel was accepted by DAI. We proposed that we may de-link from SSC and adopt the recruitments method adopted by Postal Deptt. where the criteria is only the marks scored by the applicant in the University or Board exams.

 

      DAI assured to take up the matter with SSC, pointing out the functional requirement of the department.

 

  6.   i) Withdraw annual audit criteria introduced vide letter dt 27 January 2011.

        ii) Stop unilateral implementation of transfer policy in Commercial Audit & P&T Audit

     

       On both the points, DAI assured to cross check with concerned wings.

 

  7.    Implement Arbitration Award on SA pay Scale

 

        The item was not further discussed as it is already being pursued with Govt of India.

 

 8.   Permit all Employees in the GP of 1800 to appear for all Departmental Exams including SOGE.

     

        DAI did not agree with the proposal of the Association.

     

        The Association was informed that DOPT is objecting to the present system of   SAS examination fast tracking promotion to AAO.

 

  9.  Extend benefits of MACP to Assistant Audit/Accounts Officers by treating promotion to    AAO as direct recruitment; withdraw the order treating promotion from Section Officer to Assistant Audit Officer between 01.01.2006 to 01.09.2008 as null and void.

 

      The Association made a detailed presentation on the item. DAI appreciated the situation and assured to have the issue examined afresh.

 

      On being explained that department has issued circular giving option for pay fixation in the case of those affected by "null & void" circular, part II of the item was not discussed further.

 

   10. Designate Supervisor as AAO & Earmark 20% of AAO post for seniority cum fitness           promotion

 

      Re-designation of Supervisor as AAO was not agreed to. DAI assured to examine the demand for raising the percentage of Supervisor post.

 

 11.   Remove differential treatment on pay fixation on promotion vis-à-vis direct recruitees in   all cadres.

      The item was not discussed as it is to be decided by the Deptt of Expr. We were informed that the Deptt is pursuing the matter.

 

 12.  Stop downsizing of P&T Audit Offices; conduct audit of private service providers as     per TRAI regulations.

 

        We were told that more than 300 Auditor/DEO have been recruited in various P&T Audit in the recent past.

 

      DAI agreed to examine the demand for audit of private service providers.

 

 13.              Re-imburse hotel charges to Railway Audit personnel wherever Railway accommodation is not allotted while on tour.

      The demand was appreciated; it was informed that the issue cannot be resolved without taking Railway Board on board. We were assured that efforts would be made in this regard.

 

 14.              Restore unilateral transfer policy.

 

      Not agreed to – for the reasons that vacancy position is yet to be at satisfactory level and majority of the recruits are from outstation.

 

      DAI stated that the relaxation can be considered only for physically handicapped personnel-after a cooling period.

 

 15.              Restore metal Pass facility to AAOs in Railway Audit

 

      The demand was appreciated. It was clarified that the issue is to be pursued with Railway Board and would be taken up.

 

 16.              Grant increment and Grade Pay of 4800 from the day of Passing of SOGE

 

After detailed discussion, we requested that during the waiting period – this position is acute in the cases of Commercial audit SAS passed candidates and Civil audit SAS passed candidates from A&E wing – the SAS passed candidates may atleast be granted one increment ie 3% of the pay, till promotion or transfer, as the case may be.

 

DAI agreed to have the demand examined.

 

In addition to the items listed above, we also raised the issue of additional chances for SAS examination as well as the introduction of negative marks for SAS and incentive/RA exam.

 

DAI assured to look into the matter.

 

On the issue of arrears of pay in the light of judicial pronouncements on the case filed of comrades of Railway Accounts from Thiruvananthapuram, we were informed that Department is following up the matter with Govt.

PFRDA BILL ABOUT TO BE ADOPTED

REGISTER STRONG PROTEST

Hold 2-hour walkout & demonstration on the day PFRDA bill is taken up for adoption

 

            The government, in a fix over the accentuating fiscal turbulence on account of mounting current account deficit and falling rupee, is going all out to surrender the best social security scheme permitting the transnational corporate sharks to loot the hard earned money of the civil servants and workers. They say implementing the Pension Bill is required to instill confidence in the investors ie in other words, the investor confidence would grow only when the poor, working people of the country is permitted to be looted of their hard earned money! And the ruling dispensation is preparing for it with the help of main opposition grouping – including the one who has recently deserted it. This is how the government plan to overcome the present day crisis! Plunging the commoner to more miseries!

 

            The opposition party says that PFRDA bill is introduced by the NDA government and hence they are duty bound to support it.

 

            In the given context, the amendment moved by Com. Basudev Acharya, Leader of CPI-M group in Lok Sabha, for ensuring minimum pension as is guaranteed under the statutory pension scheme is sure to be defeated. It is time to realise who is with us and who are not.

 

            The whole interest of the ruling dispensation and the opposition is to "instill confidence in the investors" and not about securing a safe life for the employees who spends their prime time at the service of the nation.

 

            Confederation and the All India State Government Employees Federation have jointly  given a call for 2hour walk-out & demonstration in all work places on the day the PFRDA bill is taken up for adoption by the Lok Sabha. We endorse the call and call upon every unit to go all out for the successful implementation of the walkout programme against PFRDA bill.

 

            Without loss of time all the units may educate the membership on the pernicious effects of the bill and also about the fact that this battle has to fought and won on own strength. The 2-hour walk out may be carried out successfully in co-ordination with the local COCs.

NATIONAL CONVENTION OF WORKERS

 

            A massive convention of workers was held on 6th August 2013 at New Delhi jointly by 11 Central Trade Unions and various independent federations/confederations. The convention, in pursuance of the 10 point Charter of Demands on which the workers had gone on three strikes during the last three years have decided the following programmes of action.

 

1. Demonstration/Rallies/Satyagraha at all state capitals with respective statewide mobilization on 25th September 2013

 

2. Massive Demonstration before Parliament with main mobilization from neighbouring states on 12th December, 2013

 

3. On the same day of Demonstration before Parliament (12th December 2013), District-level Demonstrations at all District Headquarters all over the country.

 

4.  Sectoral programme of joint actions for effectively opposing Restructuring, Outsourcing etc. and on sector-specific issues/demands and against Divestment of shares in Pubic Sector Enterprises.

 

5.  Exclusive Joint Action Programmes on the demand of Minimum Wage and Contract Workers related other demands.

 

            Confederation is a party to the Convention. All India Audit & Accounts Association endorses the programme of the actions adopted by the Convention and urges all the affiliated Associations to join the actions at the local level, under the banner of local COC.

TAKEN UP FOR DISCUSSION

IN PARLIAMENT

 

 

As you are aware, Central Government is going ahead with their agenda on pension privatization. The controversial PFRDA Bill (Pension Fund Regulatory and Development Authority Bill) is listed as an agenda item for the current Parliament session. The bill may be taken up for discussion in Parliament on any day. Confederation of Central Government Employees & Workers has opposed the Contributory Pension Scheme and also the PFRDA Bill from the very beginning.

 

We have conducted so many agitational programmes including strike. The left parties in the parliament have also strongly opposed the Bill. Inspite of the opposition from employees (both Central Government and State Government Employees & Teachers) and also from left political parties, the Central Government is not ready to withdraw the contributory Pension scheme or to scrap the PFRDA Bill.

 

The National Secretariat of the Confederation has viewed the move of the Government with grave concern and decided to call upon the entirety of the Central Government Employees & Workers to organize mass protest demonstration in front of all offices throughout the country after walking out from offices for two hours, on the day when the bill is taken up for discussion in Parliament or on the next day if information is received late.

 

All India office bearers, State level COCs and other COCs are requested to make the two hours walk out programme a grand success.

NATIONAL CONVENTION OF WORKERS

CENTRAL TRADE UNIONS HELD NATIONAL WORKERS CONVENTION

AT NEW DELHI ON 06TH AUGUST 2013

 

A massive National convention of all Central Trade Unions, Central and State Government Employees &; Teachers Federations and Public Sector employees Unions etc was held at Mavlankar Hall New Delhi on 6th August 2013. The convention was addressed by the leaders of BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF. Presidium consisted of the leaders of all the above Central Trade Unions. The resolution adopted by the National convention called upon the workers to organize following.

The National Executive Committee that met at New Delhi on 23-24 July 2013 decided that a team from the NE would visit stations and interact with the leaders, activists and members so as to ensure reinvigoration of the organisation.

 

The programme of visits is being finalised and shall be communicated by next week. It is felt that certain inputs from the Units would help the visits to be more effective and purposeful. Every Unit, therefore, is requested to give a detailed response to the questionnaire given below. 

 

            1.         What is the strength of the Executive Committee as per Constitution. Specify if the actual strength varies (EC for 2013-14).

 

            2.         How many times the Executive Committee met during the period 2012-13, what was the average attendance in the EC meetings?

 

            3.         When the election to the EC was held (in 2013)?

 

            4.         Whether the EC regularly discuss the circulars from HQr and Confederation and also Auditlekha Samanvay?

 

            5.         What is membership after the latest verification – please specify the percentage with reference to the total number of eligible membership?

 

            6.         Whether reporting on the 46th Conference was made in the EC meeting, activist meeting and General Body meeting?

 

            7.         Please state the rate of subscription and when it was revised last.

 

            8.         Please send copy of the audited statement of accounts along with annual report for the year 2012-13 and also copy of the letter submitted to the Department with audited accounts.  (pl furnish it, even if sent along with the list of new EC).

 

            10.       During the year 2012-13 & from April – July 2013, how many correspondences have been made with local Authority?

 

            11.       i) How many formal meetings have been held with PAG/AG/DG/PD and how many times met the authorities informally – during the period mentioned at 10.

 

             12.      i) Whether Office Council is functioning & when the last meeting was held.

                        ii) When the agenda for Office Council meetings was submitted last. (This is not applicable to Category II Associations).

 

             13.      i) How many GB meeting held Since April 2012?

                        ii) Whether GB meetings are held jointly by Cat II and III/ how many held were jointly?

                        iii) Whether joint GB held with AOs Association, if so how many?

 

For all points above the period under reference is 2012-13 and 2013-14 (upto 31st August 2013)

 

              14.     Please elaborate the role of the Unit in the functioning of Confederation in your station –

                                   

                                    i) The position held by the unit in the State/local COC set up.

 

                                    ii) Do your Unit attend all the meetings of Confederation/COC?

 

                        iii) Pl specify the actions during the last one year where the Unit took leadership role in the implementation of Confederation calls.

THE JUDICIAL PROCESS IN PAY PARITY ARREARS CASE REACHES ITS FINALITY-

 REVIEW PETITION DISMISSED

            The victory of Junior Accounts Assistants of Railway Accounts in the legal fight over the payment of arrears on account of upgradation of pay scales of audit and accounts employees with effect from 1.1.1996 was reported in our Circular 4 dated 26th February 2013. To make things fresh, a brief of the same is reproduced.

            The pay of UDCs in IA&AD and Assistants in CSS were at par upto the year 1919. With the implementation the Islington Commission report (on pay revision etc.), the UDCs of IA&AD were downgraded. The struggle for restoration of parity in pay scale is as old. The All India Audit & Accounts Association was formed on 15th April 1923 with the idea of forming a body that could represent to the Imperial government on the issue of restoration of pay parity.

            It took years for the 'petitioning' Association to become an Association that leads struggles on the issue parity and other issues; negotiate on the strength of struggles. After much protracted struggles and negotiations backed by agitations, the issue of parity in pay scale was partially settled in 1984 with the restructuring of cadres in IA&AD. But that left good number of personnel high and dry and the effort for total parity continued. The 4th CPC extended the parity in pay scales to all sections, including the organised Accounts that were left out of the restructuring of cadres in IA&AD, effected from 1.3.1984. (Of the Organised Accounts, Civil Accounts and Postal Accounts were an integral part of IA&AD up till 1st Sept 1976).

            The parity that was achieved in 1984 and broader parity achieved with the recommendation of 4th CPC from 1.4.1987 was breached when the government unilaterally upgraded the pay of Assistants in CSS w.e.f 1.1.1986 in 1990. The struggle for restoration of parity gained momentum under the banner of JAC of Accounts and Audit Employees Organisations.

            After a long, sustained efforts of the then JAC leadership backed by various forms of agitations including two strikes throughout the country across audit and accounts organisations, the parity was restored vide an OM dated 28th February 2003, notionally with effect from 1.1.1996 and actually from 19.2.2003.

            JAC continued its efforts to get related issues resolved through dialogue. Some of the employees from Railway accounts approached court of law in various stations for getting the upgradation of pay scale – restoration of parity – actually from 1.1.1996.

            CAT, Ernakulam upheld the contention of Shri Jose Sebastian and others that they are entitled for arrears of pay from 1.1.1996 to 18.2.2003. The case was fought at different courts by the All India Railway Accounts Staff Association, which is a constituent of JAC. The High Court of Kerala and the Supreme Court also upheld the CAT judgement.

            The government as is its wont, instead of implementing the CAT judgement universally, went on a review petition and the same bench that considered the SLP has dismissed the review petition also. HQr has mailed the copy of the judgement to all the units and a copy is enclosed along with this circular.

 

We have written to CAG

            Immediately on receipt of the copy of SC's decision on SLP filed by Government, we had written to Govt (from JAC) as well as to CAG for its universal implementation. Again we have written to CAG.

            If the government does not implement it for all similarly placed personnel – from Auditor/ Accountant to AAOs – we may also have to consider steps that will force the government to implement it for all. HQr would consult other constituents of JAC and take appropriate decision.

 

Disruptor's can never be saviours, they will always be spoilers

            Disruption was initiated by those who said that parity should be demanded only for Audit. They did not want to fight, took recourse to court. The All India Audit & Accounts Association took the stand that court cases on higher pay scale etc (not on date of effect, please note) can be a double edged sword, it can cut either way.

            The result is for everybody to see. The case, won at lower level, was rejected by SC and curative petition was also dismissed. That is the only contribution of these disruptors – i.e. they got the parity with Assistants in CSS rejected by SC, giving a handle to forever. Great contribution for the cause of Audit employees!

            There is an attempt by another section of disruptors to make claims on the victory of All India Railway Accounts Staff Association. They even propagate that it is their case, shamelessly.

 

Our Salutes

            All India Audit & Accounts Association is clear in its perspective – that on the issue of principle of parity in pay scale, courts cannot be solution and only negotiation backed by agitation will bring results. But on issues such as date of effect etc. the victory of Railway Accounts comrades are quite satisfying and we congratulate the rank and file of All India Railway Accounts Staff Association for the magnificent gift to the entirely of Audit and Accounts movements.
