DASTARDLY ACT UNDER DRACANIAN RULE –
4 COMRADES DISMISSED UNDER ART. 311 (2) (b) IN O/o AG (A&E), UP ALLAHABAD
PROTEST AGAINST THE ATTACK BY CAG ON RIGHT TO PROTEST
Hold demonstration on 15th March 2012
The CAG administration has struck with vengeance again, this time in Allahabad, UP. 4 comrades – RK Mishra, Anil Mishra, Maher Pratap Singh and Sanjay Kumar – are dismissed under Article 311 (2) (b) of the Constitution which states "where the authority empowered to dismiss or remove a person or to reduce him in rank is satisfied that for some reason, to be recorded by that authority in writing, it is not reasonably practicable to hold such inquiry".
The employees in AG (A&E) Allahabad were agitated for sometime on account of the pressure of work and forcing of employees to work on Saturdays and other holidays without even a compensatory off. On 24th February 2012 the DAG/Admn (Sachin Kapur) ordered closing of all the entry/exit points of the office at about 3 pm and started head count of the staff. Security of the personnel working in the office was not at all a matter of concern for that gentleman.
The employees on their own rose against this ill treatment and raised their voice. The pandemonium lasted for hours. The anger was directed more against the Accountant General I who was over all in charge – as AG II where the head count of the employees was conducted was on leave. The atrocities against the employees was being perpetrated by the PK Tiwari, AG I.
PK Tiwari has got a background of ill-treating the employees – in Agartala and then in Rajkot. There were so many allegations against him when he was in Rajkot. But, for the CAG administration he is a darling and the employees protesting against officers like him are villains.
Article 311 (2) (b) is put into practice in IA&AD for the first time. It is a clause rarely used. For more than 30 years, in central govt offices, nobody has been victimised under Art 311 (2) (b). The credit (!) goes to the die-hard bureaucracy of IA&AD.
This is an attack on the very right of the employees to protest against the vandalism of the officers of IA&AD.
We find that the present day administration is doing their best to undermine the unity of the employees by resorting to most unethical means as well as bending and ending rules. The Circular stating that permission for demonstration should not be granted in the office premises is one of them.
The Central Head Quarter calls upon every unit to mobilise the employees against the nefarious games of the administration and the most heinous attack on the employees of Allahabad.
All the Units may hold demonstration on 15th March 2012 and send the following telegram to CAG – endorsing a copy to HQrs.
