INDEFINITE STRIKE DEFERRED

 

The National Executive of the Confederation of Central Govt Employees and Workers met at New Delhi on 15th January 2009 and reviewed the preparations for the indefinite strike from 20th January 2009. The meeting unanimously concluded that there is need for more preparation for the strike to be really effective. The meeting therefore decided to defer the proposed indefinite strike from 20th January 2009.

A meeting with Prime Minister at the initiative of the Com Basudev Acharya, MP may take place on 22nd January 2007 (the meeting could not take place on 15th Jan due to pre-occupation of the Prime Minister).

The National Executive urged upon every affiliated Associations/Federations as well as COCs to continue with campaign with renewed vigour. The National Executive shall meet in February 2009 to take appropriate decision.

Confederation Circular 25 dated 15th Januarys 2009 is attached.

 

            Accordingly, our units may intimate the heads of offices about the deferring of the strike. Format of the letter is given elsewhere in this circular.

            The meeting of the National Executive of the Confederation was held at New Delhi today to review the preparation for an indefinite strike action scheduled to commence from 20th January, 2009.  The meeting heard the Secretaries of the affiliated Associations/Federations and Unions as also the secretaries of the Co-ordination Committees. The Comrades who were deputed to attend the State level Conventions also made their observations at the meeting. Most of the Speakers expressed the need for further time to reach out the membership in far flung areas.  The meeting came to the conclusion that more intensive mobilization and campaign programmes are needed to successfully carry out the strike action with full participation of the membership.  It was therefore decided not to commence the strike action from 20th January, 2009 but defer the same to a future date and carry out an intensified campaign amongst the mass of the employees.  All affiliates will advise their State leadership to visit all branches and hold meetings to explain the Charter of Demands, educate and mobilise their employees for the eventual strike action.  Campaign material circulated by the Confederation (CHQ) (available at its website: confederationhq.blogspot.com) will be translated into vernacular and circulate amongst the members.  The said campaign should be concluded by 15.02.2009. The National Executive will meet again in February to take further decision in the matter.

 

            The representatives of the Confederation were to meet the Hon'ble Prime Minister today in a delegation with Com. Basudeb Acharya, MP to seek his intervention in bringing about a settlement of the Charter of Demands.  This meeting could not take place due to the preoccupation of the Hon'ble Prime Minister.  The meeting is likely to take place on 22nd January, 2009.

 

            The copy of the letter addressed to the Cabinet Secretary to convey the decision of the National Executive is enclosed.

STRIKE NOTICE SERVED; PLUNGE INTO MOBILISATION

            On 2nd January 2009, the Central Government employees assembled in thousands in one voice declared the determination to go on indefinite strike from 20th January 2009 in pursuance of the 20 point charter of demands. After a massive rally in front of the Parliament, the President and Secretary General of Confederation together served strike notice on the government.

            As per the decision of the National Executive of the Confederation, as an affiliate of Confederation All India Audit & Accounts Association served notice for indefinite strike to CAG. The charter of demands has two sections: one, 20 point common demands and two, 16 point departmental demands.

            We have vide our notice requested CAG to discuss and settle the departmental demands. Copy of the strike notice served by Confederation and our Association is enclosed.

SERVE STRIKE NOTICE ON 6TH JANUARY 2009;

HOLD MASSIVE DEMONSTRATIONS

            All the Units should make earnest effort in enlisting the participation of every member in the demonstration on 6th January 2009. The text of the resolution that is to be adopted by the units on 6th January 2009 is once again given along with this circular. They may hand over the notice to the heads of offices in a delegation of the Executive Committee.

Each unit may send report to head quarter on the strike notice serving by sms followed by letter.

All Units should ensure maximum participation in the Convention held at each station.

DO NOT FORGET…

            Please do not forget that the strike action is not only against the Government of India's diabolical game of pampering the rich and mighty while neglecting the ordinary employees, it is also against the inhuman administration of the CAG.

            This fight has to be obviously against the rude, discourteous and self serving IA&AS as well. The CAG's administration has no concern about the constitutional obligations bestowed on CAG; it is concerned about it itself. The fight has to be essentially against the policy of egalitarianism that is being imposed upon the IA&AD, in pursuance of the government policies.

            The reduction of quantum of audit in all areas, the refusal to have full PRI audit, the introduction of risk based audit and over importance to performance audit and total neglect of accounting functions are reflections of deep malaise that has been consciously afflicted on the IA&AD by the administration.

            For minor reasons –many times flimsy and frivolous - the employees and officers are proceeded against, chargesheeted and suspended and heavy penalties imposed.

            But who will take action against an administration that violates the constitution itself?

            This struggle and mobilisation is essentially on these also, for our self respect also.

REVISED JAC CIRCULAR ISSUED

            Certain error occurred in the JAC Circular 7-2008 inadvertently- while placing our demand for pay scales, the pay scales sought for AO/SAO were omitted. The error is deeply regretted.

            Corrected Circular issued by the Convener, Apex JAC is enclosed.

HOLD PROTEST DEMONSTRATION AGAINST GE TAKE OVER IN BIHAR

            All units should adopt the resolution circulated vide Circular 30-2008 urging the state government of Bihar to desist from taking over of GE functions from AG (A&E), Bihar after holding demonstration on 6th January 2009. Draft resolution is reproduced elsewhere.

            Copy of the resolution adopted may be sent to head quarters.

Charter of Demands

 

Section 1

 

      Part I 6th CPC related issues

1.   Grant Rs 10000 as minimum wage as per 15 ILC Norms.

2.   Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise of 40% in emoluments and raise grade pay to 50% of the maximum of the pre-revised scales in respect of PB 1,2 & 3 as has been done in the case of PB 4.

3.   No abolition of Gr.D. Posts and functions. Lift ban on recruitment, fill up all vacant posts and scrap screening Committee.

4.   Grant 10% of pay+ Grade pay as minimum benefit on promotion or financial up gradation.

5.   Fix the date of effect of all allowances as 1.1.2006.

6.   No performance related pay or bonus scheme

7.   Revise the Transport and daily allowances as demanded by the staff side JCM National Council.

8.   Remove the condition of 6 months for applying the uniform date of 1st July as increment dates.

9.   ACP to be on hierarchical system obtaining in each department.

10. Retain and improve CGHS and make insurance scheme optional

11.  Implement flexitime working hours for women/disabled employees as recommended by the 6 CPC and remove clause (iv) of OM No.13019/2/2008-Estt.(L) dated 18th Nov. 2008 on Child Care Leave.

12. Direct all the Departmental Heads to settle 6th CPC related department specific demands/problems within a stipulated time.

13. Grant civil servant status and Pension to 'Gramin Dak-Sevaks.'

14. No reduction in the commutation value and restoration of full pension after 12 years.

15. Compute the pension entitlement on the basis of notional pay as on 1.1.1996

 

Part II - Demands pending settlement for long in the National Council JCM

1. No outsourcing or contractorisation of Govt. functions.

2. Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.

3. Implement the Board of Arbitration Awards.

4. Remove the arbitrary 5% ceiling and 3 years condition on compassionate appointment and withdraw court cases and absorb all waitlisted RRR candidates.

5. Implement the revision of bonus ceiling @ 3500/- in the case of all personnel employed by the Government including casual/contingent and daily rated workers and Grameen Dak Sewaks. Replace adhoc bonus with the PLB and remove the 60 days ceiling.

Section II

 

1.     a)  Vacate victimization of Association activists.

b) Allow democratic functioning of Association without interference from        administration

   2.        Strengthen Audit & Accounts to Safeguard People's Rights

 

a)      Stop down sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap curtailment/shedding of Audit functions in the name of Audit Plan.

b)      Ensure continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms.

c)      Ensure effective Panchayati Raj Audit & Accounts by sanctioning more posts.

 

3.         Redesignate LDC as Audit/Accounts Assistant, grant PB1 Grade Pay 2800 (4500-7000 pre-revised) and grant following pay scales to other cadres, maintaining vertical relativity.

                                    SA/Steno Gr I                                        : PB2, GP 4600

                                    SO/AAO/Private Secretary       : PB2, GP 4800

           & PB3 GP 5400 on completion of 4 years

4.   Fill up all vacant posts and sanction adequate post as per the agreement of 16.10.1992.

5.        a) Amend Company Law and DPC Act for Audit of Public Sector Undertakings      &  Corporations even after reduction of Government share to below 50%.

b) Amend Company Law to ensure the Audit by IA&AD of all Public Limited Companies listed with Securities and Exchange Board of India (SEBI)

            c) Enact necessary law to bring audit of all public Financial Institutions by IA&AD.

 

6.          Permit graduate Gr.D employees to appear SOG Examination as before.

 

7.       Step up of pay of senior promotees who exhausted ACP, in the event of juniors drawing more pay on getting ACP.

 

8.         Grant ACP on hierarchical pattern.

 

9.     Re-designate Supervisor as Section Officer; grant further promotion upto AO/SAO;  earmark   20% of AAO (SO) cadre for Supervisors.

 

10.       Grant promotion to employees against the direct recruitment quota.

 

11.       Regularise the ad-hoc Section officers by creating sufficient posts; promote all SOGE passed hands as one time measure; Grant one increment and Grade pay of AAO on passing SOG Exam.

 

12.       Restore unilateral transfer policy.

 

13.       Restoration of provision of Metal Passes to AAO's working in Railway Audit Offices.

 

14.     Remove the economic criteria for Compassionate ground appointment and re-open all past cases.

 

15.              Revise TA/DA rates and permit self certification to claim re-imbursement of food  and conveyance charges

16.              Grant three increments on passing departmental Confirmatory examination.

            This mass meeting of ……….. Association, …  record our strong resentment against the arbitrary, unilateral decision of the state government of Bihar to take over the gazetted entitlement functions from AG's office in two phases, from 1st January 2009 in respect of All India Services and from 1st May 2009 in respect of all other gazetted officers.

 

            This meeting urges upon the Government of Bihar to retrace its step to take over the gazetted entitlement functions to safeguard public interest and accountability.

 

            This meeting also urges upon the CAG of India to prevail upon the State Government of Bihar from taking of the GE functions.

 

            This meeting further urges upon the CAG of India to protect the interest of the employees of office of the Accountant General (A&E), Bihar, Patna.

            At the very out set, we wish you a very happy and prosperous New Year, 2009.

           

Due to some typographical error, the demand framed in respect of the AO and Sr. AO by the apex JAC meeting held on 13th December, 2008 did not appear in the draft charter of demands circulated through the JAC Circular No - JAC/Circular -7/2008 dated 16th December, 2008. We regret for the unintended mistake. The corrected draft Charter of Demands is as furnished below-

 

1.       Implement arbitration award by granting higher pay scale notionally w.e.f.1-1-1986 and effectively w.e.f 1-1-2006.

 We also request all constituents and local JACs to mobilise the Accounts and Audit Employees and Officers for the indefinite Strike from 20th January, 2009 and make it a grand success.
